Abstract

The Free Nutritious Meal (MBG) Program is a national strategic policy aimed at improving the nutritional status of students and supporting human resource development toward Golden Indonesia. However, in its implementation, there is a potential risk of food poisoning incidents that could adversely affect student health. This study aims to examine the fulfillment of legal protection for poisoning victims and to analyze legal certainty regarding the liability mechanism of the parties involved in the MBG program. The research method used is normative legal research with statutory and conceptual approaches. The results of the study show that legal protection for victims includes preventive protection in the form of implementing hygiene-sanitation SOPs and compliance with food safety standards (Law No. 18/2012), as well as repressive protection in the form of guaranteed emergency medical treatment, information transparency, and compensation in accordance with the Consumer Protection Law (Law No. 8/1999) and Presidential Regulation No. 115/2025. Legal certainty regarding liability involves the National Nutrition Agency (BGN), the Nutrition Fulfillment Service Unit (SPPG), food suppliers, and schools in an integrated manner through administrative, civil (Article 1365 of the Indonesian Civil Code), and criminal sanctions. The study emphasizes the need for detailed technical regulations to eliminate procedural barriers in fulfilling the victims' right to compensation.
