Abstract

This study is presented to analyze the oversight function of the House of Representatives (DPR) in recruiting public officials through the fit and proper test from the perspective of Fiqh Siyāsah (Islamic constitutional jurisprudence). The issues examined include the mechanism and problems of DPR’s fit and proper test, and its analysis based on the principles of amānah (trustworthiness), ahliyyah (capability), shūrā (consultation), and maṣlaḥah (public interest). This normative juridical research employs statutory, conceptual, and comparative approaches, drawing on primary sources such as the Qur’an, Hadith, the 1945 Constitution, and classical Islamic constitutional works like al-Aḥkām al-Sulṭāniyyah. The findings indicate that, mechanistically, the fit and proper test represents a modern manifestation of shūrā and ḥisbah in overseeing official appointments. However, in practice, distortions such as political bargaining, subjective assessment, and lack of transparency contravene the principles of ‘adālah (justice) and amānah. Islam emphasizes a balance of moral integrity (al-amānah) and expertise (al-kifāyah), as well as an objective evaluation founded on clear argument (ḥujjah). The study concludes that an ethical reorientation is necessary, integrating the values of ṣiddīq (truthfulness), amānah, tablīgh (communicative competence), and faṭānah (wisdom) into the eligibility test parameters to achieve genuine public maṣlaḥah.
