Abstract

This study aims to analyze the application of the principle of legal certainty in the imposition of administrative sanctions in the form of business license revocation for labor violations within the Risk-Based Business Licensing System (OSS-RBA), based on Government Regulation Number 28 of 2025. This study is motivated by the absence of clear parameters regarding the level of labor violations that may serve as grounds for license revocation, thereby opening broad discretionary space for government officials and creating the potential for legal uncertainty as well as disproportionate administrative action. This research employs a normative legal method, utilizing statutory and conceptual approaches. Primary and secondary legal materials were collected through literature review and analyzed prescriptively using methods of legal interpretation, legal reasoning, and legal argumentation. The findings indicate that the revocation of a business license cannot be executed solely on the grounds of a labor violation; rather, it must comprehensively consider four parameters: the risk level of the business activity, the results of government oversight, the severity of the violation assessed through its type, impact, element of intent, duration, number of affected workers, and recurrence as well as the stage of administrative sanctions already imposed and the business operator's good faith in undertaking corrective measures. License revocation must be positioned as an ultimum remedium, applied only after lighter administrative instruments have proven ineffective in restoring the operator's compliance. This study recommends the formulation of clearer and more operational parameters to ensure legal certainty, prevent disproportionate government action, and prevent the abuse of authority in the consistent application of administrative sanctions against business operators across government institutions.
