Abstract

Divorce may only be effected through a court judgment. Empirically, divorce petitions do not always include claims for child support payments. Judges are only permitted to adjudicate matters that are expressly requested by the parties in their claims or petitions. This raises a concern regarding the extent to which the principles of ex officio and ex aequo et bono can be implemented without contravening the principle of ultra petita (ultra vires). This study utilizes a normative juridical methodology reinforced by empirical juridical research. The case approach and the statutory approach are the approaches applied. The study utilizes both primary and secondary data, and a descriptive qualitative method is used for analysis. Judicial decisions imposing child support obligations remain dependent upon the existence of claims submitted in divorce petitions. However, the codification of legal norms concerning child support obligations in statutory regulations, as well as the Supreme Court Circular Letter (SEMA) No. 4 of 2016, gives judges legal basis to impose child support obligations without concern that such decisions would violate the principle of ultra petita (ultra vires).
