Abstract

Family conflict is part of the dynamics of domestic life and, from an Islamic perspective, does not necessarily have to end in divorce. Social changes, economic pressures, transformations in family roles, changing patterns of communication, and the development of digital technology have made family conflicts increasingly complex in the modern era. This study aims to analyze family conflict resolution from the perspective of Islamic family jurisprudence (fiqh munakahat) and to formulate its reconstruction in order to address the needs of modern families. This study employs a qualitative method with a library research approach through an examination of fiqh literature, Islamic legal sources, legislation, and relevant journal articles. The findings indicate that Islamic family jurisprudence provides mechanisms for resolving family conflicts through ṣulḥ, taḥkīm, and mediation, which are oriented toward reconciliation, justice, and the realization of family welfare. In the modern context, these mechanisms need to be reconstructed through a comprehensive, integrative, adaptive, and preventive approach that takes into account legal, psychological, social, economic, communicative, and technological dimensions. The reconstruction of family conflict resolution should not merely aim to end disputes but also to prevent conflict escalation, protect the rights of family members, and preserve marital harmony whenever possible.
