Abstract

This study aims to analyze the implementation of Minister of Trade Regulation Number 51/M-DAG/PER/7/2015 regarding the trade of used clothing on the TikTok platform and to examine the practice from a Sharia economic perspective. The study is motivated by the prevalence of imported used clothing sales via e-commerce—activities that contravene existing regulations yet remain popular among the public due to pricing and trends. A literature review method employing a normative-juridical approach was used, analyzing primary, secondary, and tertiary legal materials through a descriptive-qualitative lens. The findings indicate that regulatory implementation remains ineffective due to weak oversight, low awareness among business actors and consumers, and the ease of digital transactions facilitated by features such as live streaming and marketplaces. From a Sharia economic perspective, this practice potentially conflicts with Maqasid Sharia principles—specifically hifzh an-nafs (protection of life), hifzh al-mal (protection of wealth), and hifzh al-bi’ah (protection of the environment)—as it poses health risks, undermines local industries, and potentially increases textile waste. Strengthening regulations, enhancing digital-based oversight, and educating the public are essential to ensure that trading practices in the digital era are conducted more ethically and safely, in accordance with legal principles and Sharia economic values.
