Abstract

Abstract: The ambiguity surrounding the ownership status of assets purchased during marriage using pre-marital savings often triggers legal disputes in marital property division. Chronologically, such assets generate a legal presumption (presumption of law) as joint property, whereas materially they represent a conversion of separate property. This study aims to analyze the legal status of pseudo-joint property through the perspective of the Real Subrogation doctrine and the Istibdal principle in Islamic Fiqh. Using a normative legal research methodology, this paper employs statutory, conceptual, and comparative approaches to examine relevant provisions under Law No. 1 of 1974, the Compilation of Islamic Law (KHI), and jurisprudence. The findings reveal that purchasing an asset during marriage using pre-marital funds does not automatically turn it into joint property, provided that the origin of the funds can be proven under the principle of substance over form. Through the doctrine of real subrogation and istibdal, the converted asset retains its legal status as separate property (harta bawaan). However, in cases involving mixed funding, a proportional division model must be applied. In conclusion, integrating the real subrogation doctrine into judicial reasoning in Religious Courts is critical to resolving evidentiary impasses, protecting individual property rights, and upholding legal certainty and justice in marital asset disputes.
