Abstract

This article examines the critical gap between constitutional ideals and empirical bureaucratic practices in Indonesia, characterized by recurring abuses of power and accountability deficits. Employing a normative legal approach, this study analyzes the urgency of constitutionally re-actualizing government authority through the paradigm of good governance. The findings reveal that discretionary power must be strictly bound by the General Principles of Good Administration (AUPB) to prevent administrative despotism. Furthermore, a collaborative oversight mechanism—integrating the legislature, judiciary, independent institutions like the Ombudsman, and civil society—is imperative. The study concludes that redefining government authority from a state-centric privilege to a transparent, publicly accountable constitutional mandate is essential for maintaining political stability, restoring public trust, and achieving substantive justice.
