Abstract

This study examines the execution power of Religious Court decisions in Indonesia through normative legal research with comparative analysis. Despite significant jurisdictional expansion through three legislative amendments, a persistent structural gap exists between the court's adjudicative authority and its enforcement capacity. Analysis of HIR, RBg, Law No. 7/1989 as amended, and the Compilation of Islamic Law reveals that the execution framework relies on voluntary compliance due to the application of colonial procedural law designed for tangible property execution, creating structural incompatibility with Islamic family rights such as nafkah and hadhanah. This research recommends systemic reconstruction through amendments to the Religious Courts Law, establishment of a national maintenance collection agency inspired by the Dutch LBIO model, direct withholding mechanisms based on the Australian model, status-based sanctions adopting US and Canadian practices, and transformation of judicial decisions toward self-executing judgments. This reconstruction is formulated while respecting maqāṣid al-sharī'ah principles that place protection of lineage and property as fundamental objectives.
