Abstract

This study aims to examine the role of the Central Jakarta Population and Civil Registration Office in protecting personal data within the population administration system and to identify the legal strengths and weaknesses of such protection. This research employs an empirical legal approach, focusing on social reality, particularly how law is applied and functions in practice. Primary data were obtained through observations and interviews at the Central Jakarta Population and Civil Registration Office, while secondary data consisted of primary and secondary legal sources. Data were analyzed qualitatively. The findings indicate that the Office plays a role in storing, maintaining, ensuring the accuracy, and safeguarding the security and confidentiality of personal data. Personal data protection is administrative in nature and involves recording both general and specific personal data. Regarding legal force, the Population Administration Act provides legal authority to protect personal data through centralized legal authority, guarantees of fundamental rights, and obligations to maintain data security and confidentiality. However, several weaknesses remain, including the failure to accommodate modern personal data protection principles, an insufficiently clear definition of personal data, weaknesses in technical and security measures, the absence of criminal sanctions, and unclear boundaries of legal liability in cases of personal data breaches.
