Abstract

This study aims to analyze the implementation of Boalemo Regency Regional Regulation Number 5 of 2014 concerning the Management of Mineral and Coal Mining in controlling Unlicensed Gold Mining (PETI) activities in Paguyaman District and identify factors that hinder its implementation. This study uses a descriptive approach with case studies and qualitative research types. The research was carried out in Paguyaman District, Boalemo Regency, Gorontalo Province, from January 23 to February 23, 2026. Data was obtained through in-depth interviews, field observations, and documentation studies involving local government officials, law enforcement officials, community leaders, and communities involved or affected by PETI. Data analysis was carried out thematically and narratively through the stages of data reduction, data presentation, conclusion drawn, and verification by triangulation of sources. The results of the study show that the implementation of Regional Regulation No. 5 of 2014 has not been carried out effectively. Based on the theory of Van Meter and Van Horn, weaknesses were found in the clarity of operational objectives, limited resources, unstructured inter-organizational communication, fragmentation of the authority of implementing agencies, attitudes of officials who tend to be ambivalent, and social, economic, and political conditions that are not conducive. Meanwhile, Daniel W. Bromley's institutional perspective shows that the weak rules of the game, the unavailability of People's Mining Areas (WPR), inconsistent enforcement of sanctions, and the strong informal norms of the community regarding mining rights are the main factors that maintain PETI activities. Therefore, PETI control in Paguyaman District requires strengthening institutions and resources, more integrated inter-agency coordination, consistent law enforcement, land conflict resolution, and providing alternative livelihoods and legal people's mining locations.
