Abstract

The expansion of social media has reshaped communication and intimacy within marriage, generating digital infidelity as a contemporary challenge to marital loyalty and harmony. This study examines the legal relevance of digital infidelity to changes in spousal relationships and divorce under Indonesian Islamic family law. The research employs normative legal research with statutory, conceptual, and case approaches, analyzing marriage legislation, the Compilation of Islamic Law, electronic evidence regulations, relevant Religious Court decisions, and Islamic evidentiary concepts of bayyinah, qarinah, and iqrar. The findings indicate that digital infidelity, despite the absence of physical sexual relations, may undermine trust, loyalty, and marital harmony and acquire legal significance when it contributes to persistent disputes constituting legally recognized grounds for divorce. Electronic evidence requires contextual assessment alongside other admissible evidence. Islamic family law may address such disputes through the principles of amanah, mawaddah, rahmah, and maqashid al-shari'ah. The study recommends clearer judicial guidelines for assessing digital evidence and interpreting technology-mediated marital misconduct to strengthen legal certainty and family protection.
