Abstract

The rapid growth of e-commerce transactions in the digital era presents new challenges for implementing the principle of justice within Islamic commercial law (fiqh muamalah). Practices such as cashback and digital discounts, which dominate digital marketing strategies, require critical evaluation from a sharia-compliant perspective. This study aims to analyze how justice can be realized in e-commerce transactions through the lens of fiqh muamalah, integrated with the principle of religious moderation (wasatiyyah). This qualitative research employs documentation and observation methods for data collection. The findings reveal that certain forms of cashback and discounts contain elements of gharar (uncertainty) and price manipulation, which may violate the validity of contracts in Islamic law. However, through the application of religious moderation which emphasizes balance, transparency, and fairness opportunities for ethical and just e-commerce transactions remain viable. Moderation serves as a vital principle in navigating the digital economy, ensuring that it aligns with Islamic ethical values. Therefore, strengthening digital sharia literacy and understanding the nature of contracts is essential for fostering a just e-commerce ecosystem.
