Abstract

This study explores the resolution of contractual disputes caused by force majeure conditions during the COVID-19 crisis, particularly in agreements related to event services such as weddings. The outbreak of COVID-19, which was declared a national disaster by the Indonesian government, led to the enforcement of restrictive policies that directly affected the ability of parties to fulfill contractual obligations. This research adopts a normative juridical approach by analyzing relevant laws, legal principles, and literature to understand the application of force majeure in contractual relationships. The results show that many agreements were disrupted due to circumstances beyond the control of both consumers and service providers, resulting in delays, cancellations, and financial losses. While consumers often perceive such situations as a breach of contract, the study finds that these conditions qualify as force majeure, thereby limiting liability. The research emphasizes the need for fair and balanced dispute resolution mechanisms, as well as clearer contractual provisions to address unforeseen events in the future.
