Abstract

This study aims to evaluate the implementation of the risk-based business licensing policy through the Online Single Submission Risk-Based Approach (OSS-RBA) for micro-enterprises in Blora Regency and to formulate policy strengthening strategies to enhance the effectiveness and equity of licensing services for sustainable micro-enterprise empowerment. The research is motivated by the fact that many micro-entrepreneurs still lack legal business status, limiting their access to financing, training, and partnership opportunities. This study employs a descriptive qualitative method using primary and secondary data, documentation, and interviews with DPMPTSP officers and thirty micro-entrepreneurs. The findings indicate that the OSS-RBA has been effective, efficient, adequate, responsive, and accurate, as evidenced by a significant increase in Business Identification Numbers (NIB) from 1,118 in 2021 to 8,132 in 2023 and 6,257 in 2024, supported by the jemput bola outreach program that reached 541 micro-entrepreneurs across multiple districts. Nevertheless, equity remains a challenge due to limited human resources and technical disruptions at the central OSS system. Based on Dunn’s six dimensions of public policy evaluation, the OSS-RBA policy is considered substantively successful but requires strengthening in human resource capacity and system stability to ensure service sustainability and fairness. The study enriches the theoretical discourse on digital-based public policy evaluation and provides practical contributions to improving inclusive and sustainable risk-based business licensing governance for micro-enterprise development.

Abstract

This study aims to discuss whether Indonesia, as one of the countries dominated by the tradition of the civil law system, is still very rigid to provide space for judges to make law formation. However, is the interpretation of the law in the context of a legal discovery process also very limited in countries with a civil law system tradition? Furthermore, whether the dominance of the civil law system tradition in Indonesia affects the development of the use of legal interpretation by judges. These things will be discussed later in this  article. In providing justice, judges are required to not only look for la bouche de la loi but must actively explore the meaning behind the regulations to produce a decision that provides justice for the litigants. However, the civil law system tradition, which is still influenced by the notion of legism, has limited space for judges to exercise discretion and is based solely on the principle of legality. This research was conducted with a doctrinal research method with a qualitative approach.  This study found that, in Indonesia, the practice of legal interpretation carried out by judges is developing quite well. Many judges have interpreted the law to make legal discoveries if the legal arguments in the cases they are handling are unclear or need to be interpreted further. The method of legal interpretation that is often used is the method of grammatical interpretation with extensive interpretation. This proves that the phenomenon of the dominance of the civil law system tradition is slowly weakening, and the regulations in the Law on Judicial Power open a gap for judges to actively make legal discoveries, one of which is through legal interpretation.

Abstract

This research aims to dig deeper into the relationship between mood, emotions, and societal legal compliance. The urgency of research lies in understanding the role of individual moods and emotions in legal compliance in society. Stability, security, and justice in society depend primarily on the level of compliance with the law, and this research highlights that an individual's mood and emotions can be a crucial factor in such compliance behavior. The focus of this research lies in the approach taken in analyzing the relationship between mood, emotions, and legal compliance, in contrast to previous research, which focused more on external factors such as law enforcement or socio-economic characteristics. This research approach method is sociological juridical and focuses on qualitative data. This research provides new insights into how these psychological factors influence legal compliance behavior in society. The finding is that positive moods, such as happiness and peace, promote higher legal compliance, while negative moods, such as anxiety or anger, can reduce legal compliance. The conclusions of this research emphasize the importance of considering psychological aspects in designing effective law enforcement policies and strategies. Understanding how mood and emotions influence legal compliance behavior can improve legal compliance and create a safer and more stable environment.
