Abstract

Analysis of regulations regarding the obligation to adjust the legal form of Regionally-Owned Enterprises (BUMD) as mandated by Article 402 paragraph (2) of Law Number 23 of 2014 concerning Regional Government and its implementing regulations, which until now not all BUMDs have carried out the mandate of the Law so that in East Java Province through the Regional Regulation of East Java Province concerning Regionally-Owned Enterprises and its amendments will be analyzed whether it has provided legal certainty. This type of research is a "normative" (dogmatic) research. To examine the existing problems, this research uses the following approaches: a statutory approach and a conceptual approach. From the results of the researcher's analysis, it was concluded that the regulations regarding the obligation to adjust the legal form of regionally owned enterprises as regulated in the Regional Government Law, Regional Government Regulations and the East Java Provincial Regulation on BUMD and its amendments have not yet created legal certainty, because there is still a legal vacuum in the legal construction regarding the mechanisms, sanctions and legal status for BUMDs that existed before the enactment of the Regional Government Law, but have not yet implemented adjustments to the legal form in accordance with the provisions of the Regional Government Law within a maximum period of 3 (three) years from the enactment of the Regional Government Law.
