The rapid development of Electronic Commerce (e-commerce) in Indonesia offers transaction conveniences but conversely triggers the proliferation of illegal goods, such as counterfeit Apple AirPods on the Tokopedia platform. Sellers exploit information asymmetry, digital manipulations (e.g., duplicating active serial numbers and cloning iOS pop-up animations), and promotional features like "Flash Sale" to deceive buyers. This study aims to analyze the legal qualification of violations committed by merchants selling fake AirPods on Tokopedia under the Consumer Protection Act and to examine the efforts and accountabilities undertaken by Tokopedia in mitigating the financial losses suffered by consumers. The research method employed is normative legal research with a statutory approach and a conceptual approach. The results indicate that merchants selling counterfeit AirPods on Tokopedia strictly violate Article 8 paragraph (1) and Article 9 paragraph (1) of Law No. 8 of 1999 concerning Consumer Protection, due to trading products with hidden defects that do not comply with quality standards and honest information. Meanwhile, Tokopedia fulfills its legal obligations under the E-commerce Regulation and the ITE Law through private regulations and an internal sanction system. These repressive measures keep Tokopedia within the protection of the Safe Harbor doctrine. Consumer rights restoration via the Resolution Center acts as an effective first-line defense, although its preventive efficacy remains hindered by merchants' semantic manipulations and the ease of creating new accounts.
