This significant divergence has major legal implications for the child’s rights, such as inheritance, child support, and guardianship. Two prominent figures with starkly contrasting views on this matter are Imam Ibn Taymiyyah and Imam al-Shafi’i.The purpose of this study is to identify, analyze, and compare the opinions and methods of legal deduction (istinbat) used by these two prominent scholars—Imam Ibn Taymiyyah and Imam al-Shafi’i—regarding the lineage of children born out of wedlock. The research method employed is a literature review (library research) with a descriptive-comparative nature and a normative-juridical approach. Data sources were obtained from the major works of these two scholars, such as *Majmu’ al-Fatwa* by Ibn Taymiyyah and *Al-Umm* by Imam al-Shafi’i.The results of this study reveal a difference between the opinions of Imam Ibn Taymiyyah and Imam al-Shafi’i. Specifically, Imam Ibn Taymiyyah holds that the lineage of a child born out of wedlock can be attributed to the biological father if he performs *istilhāq* (a legal act of acknowledging paternity), provided that the mother is not a farisy or the wife of another man; if the mother is married to another man, the child’s lineage remains unestablished and is not connected to the biological father. Meanwhile, according to Imam al-Shafi’i, the lineage of a child born out of wedlock is severed from the biological father, and the child’s status is categorized as ajnabiyyah (a stranger). In Indonesian positive law, there are two provisions addressing the lineage of a child born out of wedlock: first, Law No. 1 of 1974 on Marriage, which states that the lineage of a child born out of wedlock is established solely through the mother, while a Constitutional Court ruling states that a child born out of wedlock may derive lineage from his biological father if there is an acknowledgment or a ruling from a Religious Court or District Court regarding the child’s parentage.
