Abstract

Civil servant neutrality is a prerequisite for professional bureaucracy and fair local elections. This study examines the regulation of civil servant (ASN) neutrality and the effectiveness of disciplinary sanctions in the Serang City local election under Law Number 20 of 2023 on the State Civil Apparatus and Government Regulation Number 94 of 2021 on Civil Servant Discipline. A normative juridical approach supported by qualitative empirical data was employed. Data were obtained through library research, interviews, observations, and review of case-handling documents, and were analyzed qualitatively and inductively. The study finds that a layered legal framework already governs neutrality through the ASN Law, election and localelection legislation, civil servant discipline regulation, code-of-ethics provisions, and implementing regulations. Nevertheless, enforcement remains suboptimal. In Serang City, one civil servant was found to have committed a disciplinary violation related to political activity and received a one-year postponement of periodic salary increase, while three other civil servants initially suspected of neutrality violations were ultimately subjected to moral sanctions for code-of-ethics violations. These findings reveal a gap between the strength of the normative framework and the deterrent effect of sanctions, associated with limited regulatory dissemination, weak supervision, and inconsistent sanction enforcement. Stronger preventive supervision, consistent application of Government Regulation Number 94 of 2021, and institutional coordination are required to safeguard bureaucratic professionalism and electoral integrity.
