Abstract

This study aims to examine the criminal liability of cooperative employees in the crime of embezzlement in office based on Decision Number 25/Pid.B/2025/PN Bar. The focus of the discussion includes proving the elements of the crime and the judge's legal considerations in issuing the verdict. The method used is empirical normative legal research with a statutory approach and a case approach. The results of the study indicate that the subjective element in the form of intent and the objective element in the form of control of cooperative funds due to an employment relationship have been legally proven. The judge's considerations are based on valid evidence, witness statements, and trial facts, so that the defendant is declared criminally responsible for the abuse of the trust of the position given to him.
