Abstract

This study examines the nature of the "Nika Londo" tradition as an instrument for legitimizing illegitimate children in the Pekat District, Dompu Regency, which often clashes with the rigidity of positive law. The purpose of this study is to analyze the role of this tradition in providing legal recognition for children and to evaluate the resulting aspects of legal certainty and justice. This study uses a juridical-sociological approach, with data collected through in-depth interviews, observations, and literature studies, which are then analyzed qualitatively and descriptively. The results show that "Nika Londo" remains a social resolution mechanism for premarital pregnancies in order to provide sociocultural legitimacy for the unborn child. This practice involves family deliberations, traditional leaders, religious leaders, and village officials, driven by factors such as maintaining family honor, social pressure, and procedural efficiency compared to formal law. The study's conclusion confirms that although this tradition provides communal protection of dignity, legally it does not guarantee absolute legal certainty for women and children without official marriage registration.
