Abstract

This research conducts a comprehensive analysis of the implementation of Good Governance principles as a critical preventive mechanism to counteract the Mayor's misuse of authority against the local educational apparatus. As the regional head, the Mayor has significant authority in managing the state apparatus, including the education sector; however, this authority is often abused through nepotism, corruption, or political intervention in employee appointments, which ultimately damages the quality of education and overall governance. The method applied in this research is purely normative-conceptual. This research focuses on the theory of administrative law, the principle of legality, the concept of Good Governance (from UNDP and OECD), and the concept of detournement de pouvoir. The research data comes from secondary legal sources, including legal doctrine, laws and regulations (such as Law No. 23 of 2014, Law No. 20 of 2003, and Government Regulation No. 11 of 2017), and international instruments, without relying on empirical or field data. The primary results indicate that the implementation of Good Governance principles is a critical key to establishing an integrity-driven and transparent local government. Conceptually, accountability, transparency, participation, and the rule of law are the main pillars for balancing the Mayor's authority in managing the state civil apparatus. The results specifically emphasize that accountability is the basis for requiring every Mayoral decision, especially those related to the appointment, transfer, and dismissal of education officials, to be legally and administratively accountable. Furthermore, transparency, including the right to obtain information and participate in policymaking, is crucial for public oversight and preventing abuse of power.
