Abstract

The crime of aggravated murder is a crime against life that has a high level of seriousness because it is committed to facilitate, ensure the success of, or maintain the results of another crime. Developments in regulations in Law Number 1 of 2023 concerning the Criminal Code and the implementation of Law Number 20 of 2025 concerning the Criminal Procedure Code give rise to the need to examine the legal regulations and criminal liability for perpetrators of aggravated murder. This study aims to analyze the legal regulations for the crime of aggravated murder and the criminal liability of the perpetrators in Indonesian criminal law. The research method used is normative legal research with a statutory, conceptual, and case study approach. The results of the study indicate that legal regulations have provided a comprehensive normative basis, while criminal liability can only be imposed if all elements of the crime, fault, capacity to be responsible, and aggravating circumstances are proven through a valid evidentiary mechanism, thereby achieving legal certainty, justice, and public protection.
