Abstract

Sexual harassment remains a serious legal and social problem in Indonesia. The enactment of Law Number 12 of 2022 concerning the Crime of Sexual Violence (UU TPKS) represents a significant normative breakthrough in regulating various forms of sexual violence, including non-physical harassment. However, normative progress has not been matched by consistency in law enforcement, as evidenced by judicial decisions that still demonstrate interpretative ambiguity and inconsistency. This study aims to analyze the legal framework governing sexual harassment in Indonesia and examine the legal protection afforded to victims. Using normative juridical research methods with statutory, conceptual, and case approaches, this study concludes that: (1) the legal framework for sexual harassment has undergone significant expansion through UU TPKS, accommodating non-physical and electronic-based forms of harassment; (2) legal protection for victims includes preventive and repressive measures; however, implementation still faces challenges in the form of social stigma, victim blaming, and limited institutional capacity. This study recommends strengthening the capacity of law enforcement officers in understanding the victim-centered spirit of UU TPKS and the need for judicial guidelines to create consistent jurisprudence.
