Abstract

Sexual violence against children in the form of rape committed by close family members (incest rape) is an extraordinary crime that deprives the victim of their human rights and future. This study aims to comprehensively analyze the implementation of legal protection for child victims of rape in Madiun Regency and evaluate the juridical and empirical obstacles faced by the Madiun Regency Women's Empowerment and Child Protection Office (PPPA) in positive law enforcement in Indonesia. Using a juridical-empirical research method, primary data was obtained through in-depth interviews with key informants at the Madiun Regency PPPA Office and the analysis of documents assisting AP children (17 years old) in the case. The results of the study show that the Madiun Regency PPPA Office has implemented five main pillars of assistance, namely legal assistance (coordination of reporting by the Madiun Police, BAP, to trial), medical (visum et repertum at Dolopo Hospital and pregnancy care), psychological (trauma recovery/fabulation counseling), psychosocial (fostering a social environment and preventing victim blaming), and education (fulfillment of the right to continue schooling). This study recommends reforming regional regulations on medical financing for victims and optimizing restitution submissions by the public prosecutor in accordance with the mandate of Law No. 12 of 2022 concerning the Crime of Sexual Violence.
