Abstract

Religious freedom in Indonesia is a fundamental right protected by the Constitution, human rights legislation, and international legal instruments. This study examined the enforcement of law in the dissolution of worship activities in Sukabumi and assessed the tension between constitutional protection of religious freedom and claims of public order. A normative juridical method was employed through statutory and conceptual approaches, supported by secondary legal materials and factual information concerning the Sukabumi case. The analysis showed that the legal framework formally protects freedom of religion and belief, but its implementation remains vulnerable to inconsistent legal interpretation, majority pressure, weak preventive protection against intolerance, and administrative requirements that may create disproportionate barriers for minority groups. The Sukabumi case also demonstrated the importance of separating criminal liability for property damage from social narratives concerning religion. The study concluded that regulatory harmonization, rights-oriented law enforcement, stronger judicial consistency, inclusive administrative reform, and sustained human rights education are necessary to protect religious freedom while maintaining public order.
