<![CDATA[ABSTRAK Badan Perwakilan Desa (BPD) yang ada selama ini berubah namanya menjadi Badan Permusyawaratan Desa sebagai wujud dari Demokrasi dan Otonomi Desa. BPD berfungsi membahas dan menyepakati rancangan peraturan desa bersama kepala desa, menampung dan menyalurkan aspirasi masyarakat, oleh karenanya BPD sebagai badan permusyawaratan yang berasal dari masyarakat desa, disamping menjalankan fungsinya sebagai jembatan penghubung antara kepala desa dengan masyarakat desa, juga harus menjalankan fungsi utamanya, yakni fungsi representasi. Permasalahan yang dikaji dalam penelitian ini adalah : (1) Bagaimana Fungsi BPD dalam proses pembentukan Perdes Berdasarkan Peraturan Menteri Dalam Negeri Nomor 110 Tahun 2016 tentang BPD (2).Faktor kendala apasajakah yang mempengaruhi pelaksanaan fungsi BPD di Kecamatan Sungai Raya Kabupaten Kubu Raya (3) Bagaimana langkah-langkah yang dilakukan untuk mengatasi kendala-kendala pelaksanaan fungsi legislasi oleh BPD di Kecamatan Sungai Raya Kabupaten Kubu Raya. Penelitian ini bertujuan: (1) Mendeskripsikan fungsi BPD Berdasarkan Permendagri Nomor 110 Tahun 2016. (2) Mendeskripsikan kendala-kendala yang dihadapi oleh BPD dalam pelaksanaan fungsi legislasi (3) Mendeskripsikan langkah-langkah yang dilakukan untuk mengatasi kendala-kendala pelaksanaan fungsi legislasi oleh BPD di Kecamatan Sungai Raya Kabupaten Kubu Raya. Metode pendekatan penelitian yang digunakan dalam penelitian ini ialah bersifat Yuridis Sosiologis. Metode pengumpulan data yang digunakan adalah: (1) metode wawancara, (2) metode dokumen, (3) metode observasi. Sedangkan metode analisa digunakan adalah metode analisa diskritif Yuridis Empiris dengan pendekatan deduktif. Hasil penelitian menunjukan bahwa pembuatan Peraturan Desa sudah dilakukan melalui tahapan-tahapan yang benar dan telah sesuai dengan Undang-Undang Nomor 12 Tahun 2011 juncto Peraturan Pemerintah Nomor 47 Tahun 2015 Tentang Desa juncto Permendagri Nomor 111 Tahun 2014 tentang Pedoman Pembentukan dan Mekanisme Penyusunan Peraturan Desa, yakni melalui tahap inisiasi, sosio-politis dan yuridis. Simpulan dari hasil penelitian di atas adalah BPD dalam melaksanakan fungsi legislasi yaitu proses pembuatan Peraturan Desa telah sesuai dengan Peraturan Perundang-undangan yang ada namun fungsi legislasi BPD belum dapat berjalan secara maksimal, hal ini ditunjukan dengan kurang komprehensipnya BPD di Kecamatan Sungai Raya dalam membingkai peraturan-peraturan desa yang masih bersifat konvensional atau kebiasaan kedalam bentuk peraturan tidak tertulis. Adapun Langkah-langkah yang dilakukan untuk mengatasi kendala yakni secara Interndan Ekstern. Sehingga saran yang diajukan dalam Tesisi ini ialah perlu adanya perhatian khususnya dari PEMDA serta perlu diadakanya pelatihan cara menyusun dan merancang Perdes bagi Pemerintah Desa. Kata Kunci: Badan Permusyawaratan Desa (BPD), Legal Decision Making, Peraturan Desa ABSTRACTThe existing Village Representative Body (BPD) has changed its name to the Village Consultative Body as a form of Democracy and Village Autonomy. The BPD functions to discuss and agree on the draft village regulation with the village head, to accommodate and channel the aspirations of the community, therefore the BPD as a consultative body originating from the village community, besides carrying out its function as a bridge between the village head and the village community, must also carry out its main functions, namely representation function. The problems studied in this study are: (1) How the BPD functions in the process of forming village regulations based on the Minister of Home Affairs Regulation No. 110 of 2016 concerning BPD (2). ) How are the steps taken to overcome the obstacles to the implementation of the legislative function by the BPD in Sungai Raya District, Kubu Raya Regency. This study aims: (1) Describe the functions of BPD Based on Permendagri Number 110 of 2016. (2) Describe the obstacles faced by BPD in implementing the legislative function (3) Describe the steps taken to overcome the constraints of implementing the legislative function by BPD in Sungai Raya District, Kubu Raya Regency. The research approach method used in this research is Sociological Juridical. Data collection methods used are: (1) interview method, (2) document method, (3) observation method. While the analysis method is used is the Empirical Juridical discrete analysis method with a deductive approach. The results of the study show that the making of the Village Regulation has been carried out through the correct stages and in accordance with Law Number 12 of 2011 juncto Government Regulation Number 47 of 2015 concerning Villages in conjunction with the Regulation of the Minister of Home Affairs Number 111 of 2014 concerning Formation Guidelines and the Mechanism of Formulating Village Regulations, namely through the stages of initiation, socio-political and juridical. The conclusions from the results of the above research are that the BPD in carrying out the legislative function, namely the process of making Village Regulations in accordance with the existing legislation, but the BPD legislative function has not been able to run optimally, this is shown by the incomprehensibility of BPD in Sungai Raya District in framing regulations - village regulations that are still conventional or habitual in form of unwritten regulations. The steps taken to overcome obstacles are internally and externally.
