Abstract

ABSTRAKTesis ini membahas tentang tanggung jawab perdata Badan Pertanahan Nasional terhadap penerbitan sertipikat hak milik ganda dengan studi kasus di Kantor Pertanahan Kota Pontianak. Adapun tujuan dalam penelitian ini adalah untuk mengungkapkan dan menganalisis tanggung jawab secara perdata Kantor Pertanahan Kota Pontianak atas terjadinya penerbitan sertipikat hak milik ganda dan upaya penyelesaian yang dilakukan oleh Kantor Pertanahan Kota Pontianak terkait kerugian para pihak sehubungan dengan penerbitan sertipikat hak milik ganda. Melalui metode penelitian hukum empiris diperoleh kesimpulan bahwa tanggung jawab Kantor Pertanahan Kota Pontianak secara perdata atas terjadinya penerbitan sertipikat hak milik ganda adalah hanya sebatas membatalkan sertipikat yang dianggap cacat administrasi maupun berdasarkan putusan pengadilan dan memberikan ganti rugi. Namun ganti rugi yang diberikan oleh Kantor Pertanahan Kota Pontianak dibebankan kepada negara dan nilai ganti ruginya tidak sesuai dengan harapan bagi pihak yang sertipikatnya dibatalkan. Dalam prakteknya, Kantor Pertanahan Kota Pontianak belum bertanggung jawab secara perdata atas terjadinya penerbitan sertipikat hak milik ganda karena apabila pihak yang dibatalkan sertipikatnya ingin menuntut tanggung jawab Kantor Pertanahan secara perdata dalam hal ganti rugi, maka harus mengajukan gugatan perdata di Pengadilan Negeri dan nilai ganti rugi yang diberikan oleh Kantor Pertanahan (yang dibebankan kepada negara) tidak sesuai dengan harapan pihak yang sertipikatnya dibatalkan. Dalam kasus terjadinya sertipikat hak milik ganda di Kota Pontianak, maka upaya penyelesaian yang dilakukan oleh Kantor Pertanahan Kota Pontianak terkait kerugian para pihak sehubungan dengan penerbitan sertipikat hak milik ganda dilakukan dengan cara mediasi terlebih dahulu, walaupun pada akhirnya para pihak menempuh jalur pengadilan. Proses mediasi yang dilangsungkan di  Kantor Pertanahan Kota Pontianak berpedoman  pada Peraturan  Menteri Agraria Tata Ruang/BadanPertanahan Nasional Republik Indonesia Nomor 11 Tahun 2016 tentang Penyelesaian Kasus Pertanahan.Kata Kunci:     Tanggung Jawab Perdata, Badan Pertanahan Nasional, Sertifikat Hak Milik Ganda. ABSTRACTThis thesis discusses the National Land Agency civil responsibility for the issuance of multiple land ownership certificates with case studies at the Pontianak City Land Office. The purpose of this research is to reveal and analyze the civil responsibility of Pontianak City Land Office for the issuance of multiple land ownership certificates and settlement efforts made by the Pontianak City Land Office regarding the loss of the parties with regard to the issuance of multiple land ownership certificates. Through empirical legal research method, it can be concluded that Pontianak City Land Office regarding to the issuance of multiple land ownership certificates is limited to canceling certificates which were considered administrative defect or based on court decisions and provided compensation. But the compensation provided by the Pontianak City Land Office is charged to the state and the compensation is not in accordance with the expectations of the party whose certificate was canceled. In practice, Pontianak City Land Office has not been civilly responsible for the issuance of multiple land ownership certificates because if the parties whose certificate was canceled wanted to sue the Land Office in a civil case regarding the compensation, then they must file a civil suit in the District Court and the compensation value provided by the Land Office (which is charged to the state) is not in accordance with the expectations of the party whose certificate was canceled. In the case of multiple land ownership certificates in Pontianak City, the settlement efforts made by the Pontianak City Land Office related to the loss of the parties in connection with the issuance of multiple land certificates is done in the form of mediation first, even though in the end, the parties take the case to the court. The mediation process held at the Pontianak City Land Office is based on the Regulation of the Minister of Agrarian, Spatial Planning and the National Land of the Republic of Indonesia Number 11 of 2016 concerning Settlement of Land Case.Keywords:   Civil Responsibility, National Land Agency, Multiple Ownership Certificate.
