Abstract

Setelah terbitnya Undang-Undang Pengelolaan zakat No 23 Tahun 2011 sebagai bagian yang dimaksudkan untuk menyempurnakan Undang-Undang sebelumnya ( UU No. 38 Tahun 1999) masih menuai kontra dari masyarakat terutama lembaga-lembaga amil zakat swasta juga kontrovesi dikalangan praktisi, akademisi, masyarakat, Lembaga Amil Zakat (LAZ) dan pihak yang terkait (stake holder) lainnya. Fakta yang membuktikan adanya kontrovesi tersebut adalah dilakukannya permohonan uji materi (Judicial review) ke Mahkamah Konstitusi/MK. Pemohan uji materi UU Pengelola Zakat tergabung dalam koalisai Masyarakat Zakat (Komaz), para pemohon mengajukan uji materiil beberapa pasal dalam UU pengelolaan zakat berdasarkan pada empat poin utama, yaitu adanya tindakan kriminalisasi, sentralisasi, subordinat, dan marginalisasi. Maka dari itu penulis dalam hal ini akan mendeskripsikan apa dan bagaimana proses perubahan regulasi zakat dari UU Nomor 38 Tahun 1999 menjadi UU Nomor 23 Tahun 2011 sampai kepada Putusan MK Nomor 86/PUU-X/2012 dari tinjauan Fiqih Siyasah adalah sebagai wujud dari kesadaran politik hukum masyarakat yang semakin tinggi terhadap hukum Islam sekaligus juga sebagai hasil upaya politik hukum masyarakat sipil yang diwakili beberapa LAZ merespon dengan mengajukan judicial review ke MK. Kesimpulannya bahwa tranformasi regulasi/hukum pengelolaan zakat dari fikih menjadi Undang-Undang adalah sebagai bagian dari usaha pemerintah untuk merekayasa masyarakat agar hukum dapat menjawab tantangan dan perubahan zaman.

Abstract

Bioplastics are plastic biopolymers made from starch that are easily degraded by soil microbes and may be an alternative to traditional plastics. Mbote tuber starch may be used as the main mass for the production of bioplastics by adding glycerin and sorbitol plasticizers. This research aims to determine the influence of plasticizers with different composition. Starch making, mixing the ingredients with plasticizer, heating, printing and drying are the sequence steps of making bio-plastic. In this study, plasticizers used glycerol and sorbitol with variations in the composition of the plasticizers 0, 0.6, 0.9, 1.2, 1.5 ml. The results showed the maximum tensile strength of glycerol bioplastic (56.12 out of 0.06) MPa with elongation (5.23 to 1.43)%, for sorbitol bioplastic the maximum tensile strength was (70, 66 then 0.09) MPa and it has an elongation value (7.85 then 0.08)%. The maximum degradability test of glycerol emollient showed that the emollient volume was 46.93% and the resolution was 3.28 mg per day and it took 14 days and 9 hours to completely reduce, while the sorbitol emollient obtained meant 1, It was 2, 4%. 5 mg is required for decomposition for 11 days and 4 hours for / day and overall reduction. The maximum area test of gliserol plasticizer is volume 0,9 plastisizer was 20,00±0,39 %, for sorbitol plastisizer is volume 1,5 plastisizer wes 14,00±0,51 %. Abstract

This study examines the dynamics of Islamic legal politics in the Religious Courts located in Indonesia’s border regions, where state law, local customary law, and Islamic law interact in complex and sometimes conflicting ways. The presence of the Religious Courts as formal state institutions represents the codified authority of Islamic family law under the national legal system. However, in border areas, these institutions often confront strong influences of local customary practices and the transnational character of religious identity that transcends political boundaries. By employing a qualitative normative approach combined with case studies of selected Religious Courts in border regions, this research explores how judges navigate the tension between upholding state law, accommodating community customs, and preserving Islamic legal values. The findings reveal that judicial practice in border areas not only reflects the legal pluralism inherent in Indonesia’s socio-legal context but also highlights the role of Religious Courts as mediators of political, cultural, and religious interests. This paper argues that the politics of Islamic law in borderland Religious Courts should be understood as a continuous process of negotiation rather than a fixed normative order. The study contributes to the discourse on Islamic legal politics by demonstrating how legal authority is constructed and contested in peripheral contexts, offering insights for the harmonization of state, religion, and local traditions in Indonesia’s legal development
