Abstract

The problem of incest, including its incidence among Muslim societies, is one of the major legal cases faced by lawyers in Malaysia. Incest cases are often hidden because they are considered a disgrace of the family and society that cannot be forgiven. As a result, justice for the victims is difficult to enforce, and the case continues to occur because the law is considered not able to ensnare the perpetrators (deterrence effect). One researcher found that among the causes of incest is the ignorance of Islamic law in everyday life, especially in applying the values of "isti'dzān" (asking for permission). The concept of "isti'dzān can keep the soul and human behavior from falling into social problems. This is because the private territory (space and time) of family members, who live in the same house, including their modesty in dressed in the house, has been regulated by Shari`a in such a way. This paper is an analysis of the legal philosophy of the concept of "isti'dzān" in relation to the incidence of sexual intercourse, and the possibility of its application among Malaysian Muslim society. This paper concludes that applying the concept of asking permission to enter the private territory of family members living in the home is important to maintain the honor of each family member. This is very likely applied in Malaysian Muslim society through religious education on "isti'dzan" in schools or places of worship. With "isti'dzan" and keeping the modesty at home, it is expected that incidents of sexual intercourse can be prevented.Keywords: Islamic permission value, Islamic educational aspect,incest problem

Abstract

Hijab, jilbab or khimar known as a piece of garment which usually worn by Muslim women in order to obey their God. It becomes a symbol that shows their identity. Besides, Hijab has a particular meaning according to multiple perspectives which resulted variant styles and types of hijab in one community, with or without syari’ah compliance. Fashion trends also plays the role in modifying women attire and the issue about this seems more complicated since the guidelines were avoided. This paper will goes through the commentaries of Qur’an to examine the requirements of proper women attire as mentioned specifically on ayat al-hijab. It results that Qur’an already put some guidelines on proper attire for Muslim women such as: the garments used to cover body parts is must be long, wide and thick enough. Not being overdressed also included as a requirement.Keyword: Hijab, Women Attire, Syari’ah compliance, Islamic Dress Code.

Abstract

The moral decadency and its degradation specifically in teenagers considered as worldwide problem nowadays. Many other cases occurred as the result of ignorance from parents, community and all those who are responsible in their upbringing and building their character such as harassment, bullying cases between teenagers and low ethic association between them. Being captivated by gender stereotypes leads to inequality and inbalance which resulted low and poor character. The duty of Prophet Muhammad saw for being sent down to people in beautifying their morals is in harmony with character building concepts mentioned in al-Qur?an. This paper analyses interactions between Musa As and the daughters of Prophet Syu?aib from surah al-Qasas which told about how to interact between genders and the balance personalities and character they owned. This research results that the perfections of Akhl?q and morals which is a symbolic of the beauty of akhl?qalso the most important point in obtaining a high quality of life.

Abstract

Imam al-Biqāʻī is one of the most prominent Quranic commentators who took care of the objectives of Quranic chapters and became the first scholar to draw attention to this science. Benefited from the science of the Quranic munāsabah, al-Biqāʻī analysed the objectives of the Quranic chapters in his books Naẓm al-Durar fī Tanāsub al-Āyāt wa al-Suwar and Maѕāʻid al-Naẓr li al-Ishrāf ‘alā Maqāѕīd al-Suwar. Therefore, the nature of this paper requires that the researchers rely on the inductive method to reach the views of scholars and Quranic commentators, especially that of al-Biqāʻī on the topic, to prove the approach of al-Biqāʻī in the purposes of the sūrah. The authors argue that relying on the sciences of the Quranic tanāsub and siyāq, al-Biqāʻī concluded that revealing monotheism is the ultimate goal of most of the Quranic chapters.[Imam al-Biqāʻī salah satu tokoh tafsir terpenting yang berkontribusi dalam Ilmu Maqāṣid ṣ al-Suwar al-Qur’āniyyah, bahkan beliau di garda terdepan dalam ilmu ini sebagai perintisnya. Dengan mendalami ilmu Munāsabah al-Quran, beliau menganalisis dan menentukan tujuan surat-surat al-Qur’an sebagaimana tergambar dalam kitabnya yang berjudul Naẓm al-Durar fī Tanāsub al-Āyāt wa al-Suwar dan Maṣāʻid al-Naẓr li al-Ishrāf ʻalā Maqāṣid al-Suwar. Artikel ini menggunakan pendekatan induktif untuk mengumpulkan pendapat para ulama dan para ahli tafsir, khususnya pendapat al-Biqāʻī, terkait disiplin ilmu tersebut untuk menelisik karakteristik pendekatan al-Biqāʻī dalam menentukan tujuan dari surat al-Quran. Kesimpulan dalam penelitian ini adalah bahwa menurut al-Biqāʻī, tauhid adalah tujuan tertinggi di sebagian besar surat al-Quran. Pandangan al-Biqāʻī ini dia dapatkan melalui dua ilmu yang menjadi referensinya, yaitu ilmu al-Tanāsub dan al-Siyāq].

Abstract

Abstract

Women’s opinions and welfare are not adequately represented and often disregarded. Even though female populations are increasing in every country, it did not automatically make it a strong reason for them to represent themselves in politics or any governance structure. The equality to take part in the public field and voice out their opinions is always underestimated by some parties with misunderstanding religious statements. By this problem, this article aims to see the statistics of women's participation in politics, their roles, and the barriers found then discuss an ideal model of women's participation from Siyāsa al-Shar`iyya’s perspective. By using an inductive and analytical method to examine several sources from books, articles, and journals, and after that draw the conclusion that the country has provided an equal right for all citizens. It is in harmony with Islam that perceives the equality of all servants without any ethnic and gender differences. Women’s involvement in politics aims to ensure a good representation of their aspirations. The available barriers did not come from religious factors but from a patriarchal system that is well embedded in the society as a culture.
