Abstract

Article 54 of the Narcotic Drugs Act stipulates that drug abuse must undergo medical and social rehabilitation, but in fact, the provisions of Article 54 are not implemented to the maximum. This is evident from the existence of narcotic abusers who became non-rehabilitated addicts but dropped criminal penalties in prison. As a result, the agency is filled with excess capacity. The study's objectives are to investigate and evaluate the legal frameworks surrounding drugs law in order to fulfill the sense of justice towards drug abuse. This research is a normative law study, exploring legal thinking about the reconstruction of a fair law against drug abuse. To support data accuracy, legislative approaches, conceptual approaches, and comparison approaches are used. In normative legal research, data collection is carried out with library research and supplemented with field research. Data analysis is done qualitatively. The results of the research show that legal constructions that provide legal certainty, utility, and justice to drug addicts and drug users through a victim perspective, access to both social and medical rehabilitation, in addition to the trusts and purposes of the Narcotics Act, are ideal and coveted legislative constructions.

Abstract

This study aims to examine the application of restorative justice to children as criminal offenders based on the 2012 SPPA Law and the 2014 Qanun Jināyat. This study is an empirical legal study using a statutory approach and restorative justice theory. Data collection techniques were carried out through in-depth interviews and literature studies. The results of the study show that Article 5 paragraph (1) of the 2012 SPPA Law stipulates that if a child commits a crime or jarīmah, a restorative justice approach must be prioritized, and in Article 7 paragraph (1), it is stated that at investigation, prosecution, and examination level of a child's case in the district court, it is mandatory to attempt diversion. The Qanun Jināyat of 2014 does not separately regulate the settlement of children who commit crimes. However, it designates laws and regulations regarding juvenile justice. Qanun Jināyat regulates the handling of children who carry out a jarīmahikhtilaṭ to carry out an examination guided by the law mentioned above. However, in the case of children who commit crimes of ikhtilaṭ and are investigated by the police, the process is carried out in a restorative justice and diversionary manner. The forms of settlement in restorative justice are reconciliation with or without compensation, return to parents or guardians, social rehabilitation, and religious rehabilitation. This study argues that restorative justice treats children in a dignified manner oriented towards juctice and the interests of the child. Likewise, the study shows that SPPA Law and Qanun Jināyat complement each other.

Abstract

Law Number 1 Year 2023 on the Criminal Code (KUHP) is a form of national criminal law reform that recognises the existence of customary criminal law. However, it has not been regulated in detail how the implementation and position of customary criminal law as a reason for criminal prosecution, and there are fundamental differences between the two concepts of the legal system. The problems in this research are how the position between customary criminal law and national criminal law in the new Criminal Code, how the legal certainty of the regulation of customary criminal law in the new Criminal Code, and how the challenges in enforcing customary criminal law using the current criminal justice system in Indonesia. This research uses normative juridical method with regulatory and conceptual approaches. The results show that the applicability of customary criminal law is limited to the area where the law lives and applies to customary criminal acts committed in the area where the law lives. The position of customary criminal law can be valid as a reason for criminal prosecution if the customary law that is still alive in the community has been stipulated in the form of Regional Regulations, and customary offences that are similar to offences in the New Criminal Code will be ruled out, and the classification of customary sanctions as additional sanctions, positioning customary penalties to be complementary or secondary, because additional sanctions can only be imposed together with the main sanctions. Legal certainty towards the regulation of customary criminal law is highly dependent on the formulation of the elements of each offence of customary criminal law stipulated in regional regulations. The current criminal justice system in Indonesia (KUHAP) cannot realise the objectives of customary criminal law. The objectives, characteristics, and procedures in the concept of customary law are contrary to those in the criminal justice system. Restorative Justice can be utilised as an alternative to the settlement of customary criminal cases when the New Criminal Code comes into effect.

Abstract

Dalam implementasinya meskipun telah didaftarkannya kopi gayo untuk mendapatkan sertifikasi Indikasi geografis nyatanya masih ada beberapa harapan yang belum terpenuhi seperti masih adanya disparitas harga yang siginifikan yang terjadi di petani dan masih banyaknya petani yang belum sadar akan manfaat yang akan didapatkan dari adanya sertifikasi indikasi geografis. Saat ini petani kopi yang berada di Tanah Gayo hanya mengetahui bahwa kopi Gayo sudah semakin terkenal namun manfaat secara finansial dan perlindungan hukum masih belum dirasakan. Dalam penelitian ini bertujuan untuk melihat sejauh apa perlindungan yang diberikan oleh Undang-undang No. 20 Tahun 2016 tentang Merek dan Indikasi geografis dalam melindungi produk yang telah disertifikasi dan juga untuk mengetahui apakah ada manfaat yang dirasakan langsung oleh masyarakat setelah Kopi Gayo mendapatkan Indikasi Geografis. Dalam penelitian ini menggunakan metode yuridis dan empiris dimana metode ini untuk melihat apakah sesuai aturan yang ada didalam undang-undang dengan yang terjadi dilapangan. Dan yang paling penting dari penelitian ini adalah untuk memberikan pemahaman kepada para petani dan juga memberikan masukan kepada pemerintah dalam hal pengembangan yang harus dilakukan terhadap indikasi geografis kopi Gayo
