Abstract

Indonesia memiliki lautan luas sumber daya perikanan potensial untuk mendukung perekonomian negara. Namun potensi tersebut belum dapat dimanfaatkan secara optimal karena tindak pidana perikanan dan belum maksimalnya penegakan hukum di bidang perikanan. Hal itu menjadi sangat penting dan strategis dalam rangka mendukung pengembangan perikanan secara terkendali dan sesuai dengan prinsip pengelolaan perikanan. Sehingga pengembangan perikanan bisa berjalan berkelanjutan. Implementasi penegakan hukum di bidang perikanan masih ada kelemahan karena rumitnya masalah kriminal perikanan, dan juga masalah mekanisme koordinasi antara lembaga penegak hukum dan pembentukan pengadilan perikanan yang tidak adil di semua negara yurisdiksi. Dalam menyelesaikan masalah, reformasi dalam penegakan hukum menjadi kunci utama yang berfokus pada substansi hukum dan sumber daya manusia yang mendukung penegakan hukum di bidang perikanan sehingga pengembangan perikanan dapat berjalan secara berkelanjutan.

Abstract

Indonesia has vast oceans of potential fishery resources to support the country's economy. However, this potential cannot be utilized optimally because of criminal acts in fisheries and not yet maximally law enforcement in the field of fisheries. This becomes very important and strategic in order to support the development of fisheries in a controlled manner and in accordance with the principles of fisheries management. So that fisheries development can run sustainably. The implementation of law enforcement in the field of fisheries still has weaknesses due to the complexity of the fisheries crime problem, as well as the problem of coordination mechanisms between law enforcement agencies and the establishment of unfair fisheries courts in all jurisdiction countries. In solving the problem, reform in law enforcement is the main key which focuses on legal substance and human resources that support law enforcement in the field of fisheries so that fisheries development can run in a sustainable manner.

Abstract

Current globalization has had an impact on goods, services, labor, etc. that flow freely between countries in the world. Indonesia itself is no exception to this global phenomenon. The free flow of trade in and out of Indonesia makes products from Indonesia vulnerable to being imitated if they are not protected, especially protecting their trademarks. Not only brands from Indonesia must be protected domestically, but they also need protection abroad. Efforts to protect brands from Indonesia can be carried out through country or international registration mechanisms. This article attempts to explain that international registration can be carried out effectively through the Madrid Protocol, which provides for centralized trademark registration at the World Intellectual Property Organization (WIPO), rather than registering trademarks centrally. Trademarks in the respective countries where the goods or services are intended to be traded. The purpose of this article is to find out how the implementation of trademark registration based on the Madrid Protocol after its ratification in Indonesia and how the impact of trademark registration carried out in Indonesia has had an impact in other countries that have implemented and ratified this system.
