Abstract

Tanah merupakan salah satu sumber kehidupan yang sangat vital bagi manusia, salah satu fungsi tanah dipergunakan untuk bermukim dengan didirikannya rumah sebagai tempat tinggal. Tujuan penelitian adalah pengaturan hukum mengenai pelaksanaan ganti rugi tanah milik masyarakat yang tidak memiliki alas hak terhadap pengadaan tanah untuk kepentingan umum dan peran jaksa penuntut umum dalam membantu pemerintah dalam memecahkan permasalahan pelaksanaan pembayaran ganti rugi terhadap bidang tanah yang tidak memiliki alas hak. Hasilnya adalah pengaturan hukum berada dalam Undang-Undang No. 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Peraturan Presiden No. 71 Tahun 2012 tentang Pengadan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Peraturan Kepala Badan Pertanahan Nasional No. 5 Tahun 2012 tentang Petunjuk Teknis Pelaksanaan Pengadaan Tanah, pembayaran ganti rugi untuk pembangunan kereta api Bandara Soekarno Hatta Jaksa Pengacara Negara dapat memberikan pendapat hukum (legal opinion) yaitu perlu dilakukan inventarisasi dan identifikasi untuk mengetahui pihak yang berhak dan objek pengadaan tanah. Jika terhadap masyarakat yang tidak memiliki alas hak, maka terhadap pihak yang dianggap dari yang memiliki itikad baik pembuktian penguasaan dapat dilakukan dengan pernyataan tertulis dari yang bersangkutan dan keterangan yang dapat dipercaya paling sedikit 2 (dua) orang saksi dari lingkungan masyarakat setempat.

Abstract

Abstract

The purpose of this study is to find out whether a Purchase Order (PO) can be categorized as a sale and purchase agreement, what is the mechanism for implementing a sale and purchase agreement between PT. Union Confectionery with PT. International Packaging Industry (PT. IPI) and what are the rights and obligations of the parties in the sale and purchase agreement between PT. Union Confectionery with PT. IPI. The type of research in writing this thesis is normative juridical which is descriptive analysis in nature. The approach method in this study is the statutory approach. A Purchase Order (PO) can be categorized as a sale and purchase agreement because a Purchase Order has the same elements as a sale and purchase agreement as based on the principle of consensualism in the Civil Code. The mechanism for implementing the sale and purchase agreement between PT. Union Confectionery with PT. IPI is the provision of boxes and wrappers using the Purchase Order (PO) system. PT. Every time Union Confectionery places an order with PT. IPI by issuing Purchase Orders (PO) which include specifications, designs, details and quantities of goods. The payment method is 45 (forty five) days after receiving the goods. Rights and Obligations of the Parties in the Cooperation Agreement between PT. Union Confectionery with PT. IPI is PT. Union Confectionery has the right to accept cardboard orders from PT. IPI according to the specifications set by PT. Union Confectionery on Purchase Orders (PO), has the right to request returns for cardboard that does not meet specifications and is obliged to pay for the order. Rights and Obligations of PT. IPI is entitled to receive payments in accordance with the agreed timely, is obliged to make cardboard according to the specifications set by PT. Union Confectionery and is obliged to replace any cartons that do not conform.

Abstract

Mixed marriages due to ethnicity have become commonplace in Indonesia. Still, a wedding occurs due to differences in the faith or religion of the prospective partner. In that case, it will cause new problems related to the legal status of the marriage or the legal consequences arising from the wedding. This type of research is normative juridical research using data from primary, secondary and tertiary legal materials. Based on the research results, it is known that some religions in Indonesia strictly prohibit it, while others forbid it but are still allowed. For example, Islam strictly prohibits marriage to faith outside of Islam. Christianity and Catholicism are also banned because they consider marriage not ideal. If the Hindu religion believes that if it is done outside of Hinduism, then the marriage is deemed invalid, while Buddhism and Confucianism do not have a problem with this. Related to the formal juridical aspect, this interfaith marriage is legal because this interfaith marriage has been recorded and has a marriage certificate issued by an official of the Population and Records Service Office by Article 2 paragraph (2) of the Marriage Law, but only in an administrative form. Meanwhile, this interfaith marriage is invalid if we look at the applicable legal regulations. From the research above, it can be concluded that unions carried out with different religions can only be registered administratively; from a legal and religious point of view, each is considered invalid because there are no clear rules governing it.

Abstract

Child adoption is a crucial process in family law, involving the legal acceptance of a non-biologically related child into another family. In Indonesia, adoption safeguards children's rights to a stable family environment, making family law's role pivotal. However, adoption in Indonesia faces challenges like complex procedures, limited information, and bureaucratic delays. This study aims to explore adoption's facets in Indonesia: its legal process, common obstacles, family law's role in safeguarding children's and adoptive parents' rights, and Law Number 23 of 2002's effectiveness in handling adoption cases. Using normative juridical research, this study analyzes secondary data from regulations and literature. Findings reveal the adoption process's intricacies, highlighting issues with legal compliance, children's rights protection, and adoptive parents' responsibilities. Courts play a vital role in ensuring legal certainty for adopted children. Adoption not only involves legal aspects but also emotional challenges for the adopted child. This research enhances understanding of Indonesian adoption and informs better family law policies and practices, aiming to improve adopted children's and adopting families' welfare and protection

Abstract

This study aims to analyze legal protection for pawn debtors concerning damage and loss of collateral in private pawn businesses. The growing phenomenon of private pawning practices without formal legality has led to legal uncertainty and increased risks to the rights of debtors. The research method employed is normative legal research with a literature review approach, utilizing data sources such as the Indonesian Civil Code (KUHPerdata), Law Number 8 of 1999 concerning Consumer Protection, Financial Services Authority Regulation (POJK) Number 31/POJK.05/2016 concerning Pawnshop Businesses, and Islamic legal instruments related to pawning (rahn). The results indicate that legal protection for debtors in private pawn businesses remains suboptimal. Although POJK Number 31/POJK.05/2016 provides adequate protection for licensed pawnshops, the regulation does not extend to individual private pawn practices. Consequently, debtors face difficulties in asserting their rights when collateral is damaged or lost. From the perspective of Islamic law, the principles of amanah (trustworthiness) and 'adl (justice) require the pawn recipient (murtahin) to safeguard and return the pledged item in good condition and to provide compensation in the event of negligence. This study recommends the need for regulatory reform to broaden the scope of legal protection to encompass all forms of pawn businesses, including home-based pawn operations. Integrating Islamic legal values, such as justice, trustworthiness, and consumer protection, into national regulations is essential to strengthen the legal standing of debtors and to create fairer, safer pawn transactions oriented toward public welfare. Thus, strengthening debtor protection not only reinforces the microfinance system but also supports the principle of social justice in Indonesia.
