Abstract

Abstract— This community service is done by the author in order to carry out one of the tasks of Tridharma as a lecturer, by helping develop Watu Bayang Tourism in Klangon Village, Saradan District, Madiun Regency. The method I use is to provide information to the Klangon village community about the development strategy in increasing tourist attraction, conducting technology training to the community in promoting Watu Bayang tourism through social media and coordinating with village governments, local governments and communities in managing tourism villages in Klangon Village. The result was obtained a strategy to develop the potential of Watu Bayang tourism area so that it could lift the shadow rock tourism area and improve the economy of the Klangon village community. Keywords—: Strategy; Attraction; Tourism.

Abstract

The consequences of globalization and liberalization of trade and investment, have an impact on the number of Foreign Workers (TKA) working in Indonesia and to support the national economy and the expansion of employment opportunities through increased investment, the government issued Presidential Regulation (Perpres) Number 20 of 2018 concerning the Use of Labor Foreign. For this reason, this study aims to analyze the policy of using foreign workers in Indonesia as a result of the issuance of Presidential Regulation (Perpres) Number 20 of 2018 concerning the Use of Foreign Workers. The research method that I use is normative juridical. The results of this study, namely the use of foreign workers in Indonesia currently supported by the issuance of Presidential Regulation (Perpres) Number 20 of 2018 concerning the Use of Foreign Workers (TKA), will have a good impact on the development of investment from abroad to Indonesia. Because basically this Presidential Regulation aims to simplify the procedure for using foreign workers to increase investment, not to facilitate the requirements of foreign workers entering Indonesia. The more investors or investors investing in Indonesia, the more new jobs that can be opened.

Abstract

Abstract— The capital market is an investment alternative for investors. Through the capital market, investors can invest in several companies through the purchase of securities offered. Investors will become shareholders in publicly-listed companies. The purpose of this study is about the position of capital market investors in the event of bankruptcy in the issuer's company and know the form of protection that can provide protection for capital market investors. The research method used is a normative research method by reviewing legislation. the position of capital market investors in the event of bankruptcy in the issuer's company is that the public shareholders are creditors who are included in the competitor (concurrent) while the form of legal protection needed is to maximize the functions and roles of OJK as the protectors of the issuer's stock which is accurately related to the performance and financial condition of public companies because the principle of openness is one of the rights that guarantees legal protection, and makes efforts to restructure the issuer's company to avoid bankruptcy. Keywords—: legal protection; investors; capital market; bankruptcy; issuers.

Abstract

This study analyzes the evolution of Beneficial Ownership regulations in Indonesia, focusing on their crucial role in corporate governance and the prevention of financial crimes, particularly Money Laundering and Terrorism Offenses. This study traces the legal framework from its basic instrument, namely Presidential Regulation No. 13 of 2018, to the significant strengthening marked by the issuance of Regulation of the Minister of Law and Human Rights No. 2 of 2025. The problems raised in this paper are (1) What is the role of beneficial ownership for corporations in Indonesian business? and (2) How can money laundering and terrorism financing be prevented in beneficial ownership for corporations? The type of research used is legal-normative, which focuses on the study of legislation and legal literature related to beneficial ownership in Indonesia. The analysis was conducted using a legislative and conceptual approach by understanding the legal framework, effectiveness, and challenges of implementing regulations in corporate practice. The results of the study show that (1) Beneficial Ownership plays a central role in increasing corporate transparency and accountability; (2) Prevention can be done with clear regulations and the implementation of beneficial ownership transparency, even though regulations have made significant progress, compliance and supervision challenges remain major obstacles. Therefore, increasing corporate awareness and capacity is essential so that the principle of beneficial ownership can effectively support the prevention of corporate crime and the creation of a transparent and accountable business environment in Indonesia. Abstract

ABSTRACT Purpose: This study aims to analyze the impact of the Constitutional Court's Decision Number 23/PUU-XIX/2021 regarding the permissibility of cassation in the Suspension of Debt Payment Obligations (PKPU). Methodology: The research method used by the researcher was a normative research method by reviewing statutory regulations and related legal materials. Results: The judge's consideration in the Constitutional Court's Decision Number 23/PUU-XIX/2021 is the permit of a cassation legal action against the decision on PKPU submitted by the creditor and the rejection of the offer of reconciliation from the debtor so that the court's decision on the PKPU application submitted by the creditor can be corrected as part of the control mechanism over court decisions at lower levels. However, with this decision, it is necessary to immediately issue implementing regulations regarding the mechanism for submitting PKPU and to control the good faith of creditors, so they do not actually injure. This is because the existence of debtors becomes a part of business actors playing a role in maintaining economic stability, so business continuity is sustained and is not misused. That being said, the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law 37/2004, which is to provide legal protection for business actors. Applications of the study: It is expected that the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law Number 37 of 2004, which is to provide balanced legal protection between debtors and creditors. Novelty/Orginalty of this study: This research is conducted due to the decision of the Constitutional Court Number 23/PUU-XIX/2021 that has recently been issued, the author analyzed the impact of the issuance of the decision on creditors and debtors. Abstract

ABSTRACT Purpose: This scientific paper aims to analyze the review of the cancellation of the Intidana Cooperative bankruptcy associated with the authority to submit bankruptcy and PKPU to the cooperative. Methodology: Using normative legal research methods, this study examined primary legal materials, including Law Number 37 of 2004 concerning Bankruptcy and PKPU, Law Number 25 of 1992 concerning Cooperatives, and Decision Number 43 PK/Pdt.Sus-Pailit/2022, as well as secondary journals, books, and scientific publications related to cooperative bankruptcy. Results: Bankruptcy proceedings against cooperatives do not have any special requirements, like those against other institutions such as banks, securities companies, stock exchanges, clearing and guarantee agencies, and other institutions. In this case, a cooperative can be petitioned for bankruptcy in the Commercial Court if it has two or more creditors and against whom a debt that is due and collectible has not been paid. The application can be filed by 2 (two) parties, namely the cooperative itself as the debtor and its creditors. The absence of regulations governing the mechanism for filing for bankruptcy in cooperatives has a negative impact on the sustainability of cooperatives. Currently, many problematic cooperatives are filing for bankruptcy and PKPU. One of the problematic cooperatives that the authors are currently studying is the Intidana Cooperative. To overcome the problems in these troubled cooperatives, the government issued SEMA Number 1 of 2022 on the Special Civil Chamber Law Formulation regarding Bankruptcy and Suspension of Debt Payment Obligations for Cooperatives, where applications for bankruptcy and PKPU statements against cooperatives can only be submitted by the Minister in charge of government affairs in the field of cooperatives, i.e., the Minister of Cooperatives and SMEs and Cooperatives that run the business of Microfinance Institutions whose licenses are from OJK can only be submitted by OJK. Applications of the study: The government is expected to immediately make changes to the Bankruptcy Law and the Cooperatives Law in terms of the mechanism for filing bankruptcy and PKPU for cooperatives, determining clear and firm boundaries between open loop and close loop cooperatives, and where OJK will supervise cooperatives that carry out financial services business activities. Novelty/Originality of this study: Analyzing the decision of the judge's cancellation of the Intidana Cooperative Bankruptcy in the Decision of Reconsideration is associated with the authority to submit bankruptcy and PKPU in SEMA Number 1 of 2022. Keywords: Decision, Bankruptcy, Cooperative.   ABSTRAK Tujuan: Tulisan ilmiah ini bertujuan untuk menganalisis kajian pembatalan pailit Koperasi Intidana terkait dengan kewenangan mengajukan pailit dan PKPU kepada koperasi. Metodologi: Dengan menggunakan metode penelitian hukum normatif, penelitian ini mengkaji bahan hukum primer, antara lain Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU, Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian, dan Putusan Nomor 43 PK/Pdt.Sus-Pailit/2022, serta jurnal sekunder, buku, dan publikasi ilmiah yang berkaitan dengan kepailitan koperasi. Temuan: Perkara pailit terhadap koperasi tidak memiliki persyaratan khusus, seperti terhadap lembaga lain yakni bank, perusahaan sekuritas, bursa efek, lembaga kliring dan penjaminan, dan lembaga lainnya. Dalam hal ini, koperasi dapat dimohonkan pailit di Pengadilan Niaga jika mempunyai dua atau lebih kreditur dan terhadapnya suatu utang yang telah jatuh tempo dan dapat ditagih belum dibayar. Permohonan dapat diajukan oleh 2 (dua) pihak, yaitu koperasi itu sendiri sebagai debitur dan krediturnya. Tidak adanya peraturan yang mengatur tentang mekanisme pengajuan pailit pada koperasi berdampak negatif terhadap keberlangsungan koperasi. Saat ini, banyak koperasi bermasalah yang mengajukan pailit dan PKPU. Salah satu koperasi bermasalah yang sedang dikaji oleh penulis adalah Koperasi Intidana. Untuk mengatasi permasalahan pada koperasi bermasalah tersebut, pemerintah menerbitkan SEMA Nomor 1 Tahun 2022 tentang Perumusan Undang-undang Kamar Perdata Khusus tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang Koperasi, dimana permohonan pailit dan pernyataan PKPU terhadap koperasi hanya dapat diajukan oleh Menteri yang menyelenggarakan urusan pemerintahan di bidang koperasi, yaitu Menteri Koperasi dan UKM yang menyelenggarakan usaha Lembaga Keuangan Mikro, dimana izin dari OJK hanya dapat diajukan oleh OJK. Kegunaan: Pemerintah diharapkan segera melakukan perubahan terhadap UU Kepailitan dan UU Koperasi dalam hal mekanisme pengajuan pailit dan PKPU bagi koperasi, penetapan batasan yang jelas dan tegas antara koperasi open loop dan close loop, dan keberadaan OJK akan mengawasi koperasi yang melakukan kegiatan usaha jasa keuangan. Kebaruan/Originalitas: Menelaah Putusan Hakim Pembatalan Pailit Koperasi Intidana dalam Putusan Peninjauan Kembali dikaitkan dengan kewenangan mengajukan Pailit dan PKPU dalam SEMA Nomor 1 Tahun 2022.  Kata kunci: Putusan, Pailit, Koperasi

Abstract

ABSTRACT This study explores and analyses the position and legal force of the Supreme Court Circular Letter (SEMA) issued by the Supreme Court, which regulates the prohibition of bankruptcy or suspension of debt payment obligations (PKPU) experienced by developers. The approach applied in this study is normative legal research. SEMA does not have a position in the hierarchy of laws and regulations and is only a circular issued by the leadership of the Supreme Court in the form of instructions, admonitions, or warnings, and its validity is only binding for judicial institutions under it. However, this legal product should not reduce the freedom of judges in examining and making decisions on a case. The prohibition on filing for bankruptcy and PKPU for developers of apartments and flats hinders the right of creditors or consumers to obtain justice. Meanwhile, bankruptcy and PKPU are tools that can help companies that are facing financial difficulties. Although consumers still have another legal alternative, namely civil suits, to obtain justice, this step is less effective given the large number of housing consumers. This mechanism can legally restructure the company's debt and provide legal certainty for creditors.

Abstract

Tujuan dari penelitian ini agar mengetahui bentuk atau tindakan penyalahgunaan aplikasi Deepfake bagi pelaku tindak pidana dan ketentuan hukum pidana yang diterapkan pada pelaku penyalahgunaan aplikasi Deepfake bagi pelaku tindak pidana. Deepfake sendiri adalah teknologi rekayasa atau sintetis citra manusia menggunakan teknologi kecerdasan buatan AI. Banyak kejahatan yang timbul dari Deepfake yaitu kejahatan pornografi yang merubah wajah seseorang yang berada dalam video tanpa izinya untuk mengambil keuntungan dengan tanpa izin orang yang memiliki wajah tersebut. Meminjam uang di aplikasi pinjol dengan meminjam wajah orang lain, merubah suara seperti Presiden Joko Widodo yang berbahasa mandarin dan lain sebagainya. Pemerintah masih belum membuat aturan yang kongkrit terkait kajahatan menggunakan AI ini, sementara hanya menggunakan UU ITE, UU Pornografi, UU Perlindungan Anak, UU PDP, untuk pencegahannya saja. Metode penelitian yang digunakan adalah penelitian yuridis normative, dengan menggunakan pendekatan Perundang-undangan, dan Pendekatan Konseptual. Semakin banyak korban dan pelaku kejahatan Deepfake ini, namun masih kabur dalam penerapan hukumnya. Hal ini menyebabkan korban tidak mendapatkan kepastian hukum dan bagi pelaku tidak akan memberikan efek jera.  Kata Kunci: Artificial Intellegence, DeepFake, Teknologi Informasi. Abstract The purpose of this research is to find out the forms or actions of misuse of the Deepfake application for criminal offenders and the criminal law provisions applied to the perpetrators of misuse of the Deepfake application for criminal offenders. Deepfake is a technology of engineering or synthetic human images using AI artificial intelligence technology. Many crimes arise from Deepfake, namely pornography crimes that change the face of a person in a video without his permission to take advantage without the permission of the person who owns the face. Borrowing money in the pinjol application by borrowing someone else's face, changing the voice like President Joko Widodo who speaks Mandarin. The government still has not made concrete rules related to crimes using AI, while only using the ITE Law, Pornography Law, Child Protection Law, and PDP Law, for prevention. The research method used is normative juridical research, using a legislative approach, and a conceptual approach. There are more and more victims and perpetrators of this Deepfake crime, but it is still blurred in the application of the law. Dalam penelitian ini mengkaji mengenai Undang-Undang Cipta Kerja Klaster Ketenagakerjaan dimana tujuan pemerintah adalah untuk meningkatkan perlindungan dan kesejahteraan pekerja dengan menciptakan lapangan kerja yang dilakukan melalui perubahan Undang-Undang sektor yang belum mendukung terwujudnya sinkronisasi dalam menjamin percepatan cipta kerja. Tujuan dari penelitian ini adalah untuk menganalisis urgensi pengesahan Undang-Undang Cipta Kerja dan menganalisis alasan Undang-Undang Cipta Kerja yang mempunyai tujuan memberikan perlindungan dan kesejahteraan pekerja justru mendapat penolakan dari para pekerja dan serikat pekerja. Metode penelitian yang penulis gunakan adalah penelitian hukum normatif. Tujuan disahkannya UU Cipta Kerja yaitu untuk memicu pertumbuhan investasi perlu dan perbaikan kualitas angkatan kerja, termasuk menginklusi para pekerja informal yang selama ini belum terakomodasi dalam UU No 13/2003. Karena itu, aspek ketenagakerjaan yang semestinya diatur di dalam UUCK adalah aspek pengembangan kualitas angkatan kerja, bukan menyangkut hak-hak pekerja, dengan tujuan menjadikan kualitas tenaga kerja sebagai daya tarik investasi.  Kata kunci : Cipta Kerja; Perlindungan; Kesejahteraan; Pekerja  Abstract This study examines the Employment Cluster Job Creation Law where the government's goal is to increase the protection and welfare of workers by creating jobs through changes in sector laws that have not supported the realisation of synchronisation in ensuring the acceleration of job creation. The purpose of this study is to analyse the urgency of passing the Job Creation Law and to analyse the reasons why the Job Creation Law, which aims to provide protection and welfare for workers, has been rejected by workers and trade unions. The research method that the author uses is normative legal research. The purpose of the Job Creation Law is to trigger necessary investment growth and improve the quality of the labour force, including including informal workers who have not been accommodated in Law No. 13/2003.
