Abstract

Majelis taklim is one place that effectively became the venue for education and propagation of Islam since the time of the Prophet until now. it socializes the teachings of Islam in building an advanced, independent and civilized society (khair ummah), provides solutions for both men and women. It functions as center for value of peace, center for community development, and the agent of social control. Majelis taklim imitates the way The Prophet Muhammad delivered revelations that he received to his companions. He did the ta’lim in some places such as Dār al-Arqām, house of the Prophet, his companions’ houses, and al-shuffah. He also provides certain days to teach religion for women. Abstract

Water and sanitation are human rights that must be met, respected and protected by the State. In guaranteeing the fulfillment of human rights over access to clean water and sanitation, women and children have vulnerabilities to human rights disturbances. Therefore, it is necessary to manage clean water and sanitation facilities with gender perspective as an effort to increase the availability of access to clean water and sanitation for the fulfillment of household / domestic needs, so that it can directly affect the quality of life of the community as a whole. In Kademangan village, Pagelaran sub-district of Malang Regency, clean water facilities management is not sufficient to meet the needs of all layers of the majority community, including the category of poor families. It is this economic reason that inhibits the villagers' willingness to build latrines, so the habit of defecating people (BAB) in any open / open river place still continues today. Communities should be given access to information and knowledge about the importance of clean water and sanitation by focusing on increasing participation and access of local communities' control over their resources. So the public recognizes its need for access to clean water and sanitation and makes it more responsible for its management and maintenance. This research focuses on the empowerment process of clean water users and women groups through participatory action research (PAR) approach given periodic assistance / organizing so that ownership of the program and group is not built at all. The creation of sustainable water supply and sanitation management systems and strengthening the capacity of communities to engage in policy-making processes and programs that are gender-sensitive and pro-poor. Abstract

Looking at the typology of pesantren, curriculum structure and direction of pesantren education, the model for strengthening nationalism is built through three stages, namely: First, input gain. This stage consists of at least three stages, namely: Stage one, scientific transmission which is carried out in three ways: (a) Teaching selected yellow books. (b) Ijab qabul guardian of students. (c) The concept of “barakah”. Stage two, transmission of activity. This stage is implemented in certain activity events. Stage three, religious transmission, such as worship (ubudiyyah), transactional practices (mu'amalah), politics (siyasa). Second, strengthening the process of nationalism in Islamic boarding schools. The strengthening process is in the form of grounding the values of tolerance (at-tasammuh), the values of balance (at-tawazun), and the values of moderation (tawasuth). This is reflected in the contents of the curriculum being taught, such as the yellow book. Debate over issues with nuances of difference (khilafiyah) with a variety of reasons makes the students understand more that differences are real. Third, strengthening the output of nationalism in Islamic boarding schools is at least a strengthening model by maintaining and overseeing Islamic boarding school graduates through communication and interaction with the kyai and their alma mater. So that pesantren graduates become alumni and individuals who are Islamic, humane, tolerant, civilized, and loving. Keywords: Pesantren, Nationalism, Strengthening Input, Process, Output

Abstract

Abstract In Dutch, the term for hibah (grant) is schenking, which refers to the act of giving by one person to another without expecting anything in return, done while the giver is still alive and irrevocable. This grant is transferred to benefit the recipient. In substance, the existence of hibah is closely related to inheritance. This is explicitly stated in Indonesia’s positive law, such as the Compilation of Islamic Law (CIL), customary law, and the Civil Code. Additionally, there is the possibility of revoking a hibah already given, as explained in the Compilation of Islamic Law, customary law, and the Civil Code, as stipulated in Article 1666. Hibah is often conducted while the giver is still alive to avoid disputes among their children after passing away. This could stem from concerns due to the children’s mother being a stepmother or foster mother or because among the children, there is an adopted child whose status as an heir might be contested. According to the provisions of Article 210(1) of the Compilation of Islamic Law, a person granting a hibah must be at least 21 years old, mentally sound, and act without coercion. They can grant up to one-third of their assets to another person or institution in the presence of two witnesses. One of the legal ways to transfer ownership in Islamic law, besides inheritance and sale, is through hibah. By granting an asset, the ownership transfers from the giver (wahib) to the recipient (mawhub lah). Islam encourages generosity as it fosters warmth and affection among people and strengthens familial ties, which is a fundamental teaching of Islam. Keywords: Grant (Hibah) Inheritance Legitime Portie Family Dispute Abstrak Hibah merupakan salah satu bentuk pemberian yang memiliki implikasi hukum signifikan, terutama dalam konteks kewarisan di Indonesia. Studi ini berfokus pada kekuatan hukum pembuktian surat hibah bersegel tahun 1967 terkait tanah pertanian yang menjadi objek sengketa di Pengadilan Agama Kepanjen dengan nomor perkara 24/PA/KPjn/2023. Dalam penelitian ini, dibahas dinamika sengketa hibah yang melibatkan ahli waris kalalah dan cucu angkat, di mana penggugat menggugat keabsahan hibah yang diberikan oleh pemberi hibah kepada cucu angkatnya. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode deskriptif analitis untuk menganalisis regulasi yang relevan, termasuk Kompilasi Hukum Islam, Kitab Undang-Undang Hukum Perdata, dan peraturan terkait pendaftaran tanah. Data penelitian diperoleh melalui studi dokumen hukum serta wawancara dengan pihak terkait, seperti penggugat, hakim, mediator, dan Badan Pertanahan Nasional. Hasil penelitian menunjukkan bahwa surat hibah bersegel memiliki kekuatan hukum sepanjang memenuhi ketentuan formal dan materiil, namun dalam praktiknya sering menjadi objek sengketa apabila dianggap merugikan ahli waris lainnya. Selain itu, ditemukan bahwa legitimasi hibah dapat dipertanyakan apabila tidak sesuai dengan ketentuan legitime portie sebagaimana diatur dalam Pasal 920 KUHPerdata. Abstract

ABSTRACT The concept of teacher-student etiquette in Islamic educational traditions holds significant relevance for modern educational challenges. This study aims to analyze Al-Ghazali’s concept of teacher-student etiquette in Bidāyah al-Hidāyah and contextualize it within contemporary education. The study employs a qualitative approach through library research. Primary data were sourced from Al-Ghazali’s work, while secondary data were obtained from books, journals, and scholarly articles related to character education and moral values. The findings reveal that Al-Ghazali's concept of teacher-student etiquette includes the teacher’s responsibilities toward students, such as sincerity, gradual teaching, and exemplary behavior, and the student’s responsibilities toward teachers, such as obedience, respect, and humility. These values align with modern character education principles that emphasize ethics, interpersonal relationships, and personality development. In the context of globalization and digitalization, these concepts can be adapted through technology-based learning strategies that uphold ethical values. This study recommends integrating etiquette values into character-based curricula, with pedagogical approaches relevant to contemporary needs. Al-Ghazali’s concept is not only applicable to Islamic education but also offers a universal contribution to character development in modern education. Penelitian ini bertujuan untuk menganalisis konsep adab guru-murid menurut Al-Ghazali dalam Bidāyah al-Hidāyah serta mengkontekstualisasikannya ke dalam pendidikan kontemporer. Metode yang digunakan adalah studi literatur dengan pendekatan kualitatif. Data primer berasal dari karya Al-Ghazali, sedangkan data sekunder diperoleh dari buku, jurnal, dan artikel ilmiah terkait pendidikan karakter dan nilai-nilai adab. Hasil penelitian menunjukkan bahwa konsep adab guru-murid yang diajarkan Al-Ghazali mencakup kewajiban guru terhadap murid seperti keikhlasan, pengajaran bertahap, dan keteladanan; serta kewajiban murid terhadap guru seperti ketaatan, penghormatan, dan sikap rendah hati. Nilai-nilai ini memiliki kesesuaian dengan prinsip pendidikan karakter modern yang menekankan etika, hubungan interpersonal, dan pembentukan kepribadian yang unggul. Dalam konteks globalisasi dan digitalisasi, konsep ini dapat diadaptasi melalui strategi pembelajaran berbasis teknologi yang tetap menjunjung tinggi nilai-nilai adab. Penelitian ini merekomendasikan pengintegrasian nilai-nilai adab dalam kurikulum berbasis karakter, dengan pendekatan pedagogis yang relevan untuk menanamkan nilai-nilai tersebut. Konsep Al-Ghazali tidak hanya relevan untuk pendidikan berbasis Islam tetapi juga memberikan kontribusi universal bagi pembentukan karakter siswa di era modern.
