Abstract

This legal counselling carried out at Village Official Hall of Kamali Pentalluan, District of Makale, Regency of Tana Toraja. In general sense, the lack of legal knowledge surrounding administrative dispute settlement on behalf of Administrative Court still remains up to now and finally the needs of legal solution laid down on reverie. Based  on this situation, village inhabitants were hard to overcome and to settle the administrative legal case themselves. In turn to accompany settling these needs, legal counselling  of  administrative dispute settlement carried out. The counselling held on flow of administrative dispute settlement. Through this counselling, all inhabitants realizes that well-understanding of administrative dispute settlement basically essential and  legal knowledge surrounding the idea significantly increased

Abstract

Based on the analysis conducted on two court decisions, namely Gorontalo District Court Decision No. 04/Pdt.G/2011/PN Gto and Tarakan District Court Decision No. 13/Pdt.G/2020/PN Tar, the results obtained illustrate the differences in the judges' perspectives in deciding moratorium interest due to default. In Decision No. 04/Pdt.G/2011/PN Gto, the judge decided that the moratorium interest to be paid by the defendant was 2 (two) percent per month, while in Decision No. 13/Pdt.G/2020/PN Tar, the judge decided that the moratorium interest to be paid by the defendant was 6 (six) percent per year or in accordance with the interest according to Article 1767 of the Civil Code. The  judge in Decision No. 04/Pdt.G/2011/PN Gto adheres to the understanding of progressive law, daring to follow the development of society. In Decision No. 13/Pdt.G/2020/PN Tar tends to adhere to a rigid positivistic understanding while still implementing the provisions of the law

Abstract

Referring to the dispute of trademark, Decision of Makassar Commerce Public Court Number 3/Pdt.Sus-HKI/Merek/2020.PN Niaga Mks expressly determined that Claimant was The Owner and The First User of Trademark Solaria. Judges extremely ignored the aspect of Solaris Trademark filing validly carried out by Defendant. Judges merely considered normatively to Trademark Acts in turn to ensure the validity of law without remarking justice inside the system of trademark’s protection in Indonesia.
