Abstract

The growth of insurance industry in Indonesia is suspected to be in line with the development of digital technology and telecommunications.Telemarketing is one of the marketing media that currently used by insurance companies. In the implementation, telemarketing system has the potential to fulfill the element of undue influence. Moreover, if one party is in a frailposition and the other party uses the situation as a benefit. The aim of this research is to analyze the existence of elements of undue influence in the insurance agreement through a telemarketing system. This research is normative study research or library research, which used a statute approach and a conceptual approach. The results of the study reveal that recording of conversation as evidence in the insurance agreement through a telemarketing system is very vulnerable to harming consumers and can fulfill the element of undue influence. Pertumbuhan industri asuransi di Indonesia ditenggarai sejalan dengan perkembangan teknologi digital dan telekomunikasi dewasa ini. Telemarketing merupakan salah satu media pemasaran yang saat ini digunakan oleh perusahaan asuransi.Dalam pelaksanaanya, sistem telemarketing yang digunakan oleh perusahaan asuransi berpotensi memenuhi unsur penyalahgunaan keadaan. Terlebih, apabila salah satu pihak berada dalam keadaan yang tidak memiliki daya dan pihak lain memanfaatkan keadaan tersebut dengan sengaja. Tujuan dari penelitian ini adalah untuk menganalisis keberadaan unsur penyalahgunaan keadaan dalam perjanjian asuransi melalui sistem telemarketing. Penelitian ini merupakan penelitian hukum normatif, dimana menggunakan pendekatan perundang-undangan dan pendekatan konseptual dalam pembahasannya. Hasil penelitian menunjukan bahwa bukti rekaman pembicaraan sebagai kesepakatan dalam perjanjian asuransi melalui sistem telemarketing sangat rentan merugikan konsumen dan dapat dikatakan memenuhi unsur penyalahgunaan keadaan.

Abstract

This study aims to assess the validity of the encumbrance of a mortgage in the form of inherited property without the consent of all heirs. Banks, as financial institutions, have a strategic role in supporting the economic growth of society, including functioning as intermediaries for the interests of parties with excess funds (creditors) and parties who need funds (debtors). Banks provide products to those in need of funds through credit facilities. They usually ask for collateral as a legitimization tool to provide legal certainty to creditors that debtors will carry out their obligations. In reality, however, mistakes or negligence can occur where the certificate is pledged as collateral has the status of inherited property but has yet to be divided. Therefore, the author examines whether the undivided inheritance is valid if pledged without all heirs' consent. This writing is normative research, utilizing a statutory and conceptual approach. The data analysis method used is the descriptive qualitative method. The results of this study show that before providing credit services, banks carefully assess the character, ability, capital, collateral, and business prospects of debtor customers. If the pledged collateral is undivided inherited property, banks require the consent of all heirs. Keywords: Bank, Credit, Inherited Property.

Abstract

The digitalization of Islamic philanthropy has compelled amil zakat institutions to adapt to technological advancements, including through partnership with e-commerce platforms such as Shopee. While this collaboration facilitates muzakki in fulfilling their zakat obligations, it raises legal questions concerning the accountability of zakat institutions in managing digital zakat funds. This study aims to examine the practice of digital zakat management via e-commerce platforms, the legal relationships among the involved parties, and the form of accountability borne by amil zakat institutions in distributing zakat through digital means. This research employs a normative legal methodology, utilizing statutory and conceptual approaches. The findings indicate that, despite the absence of specific regulations governing zakat through e-commerce, zakat institutions remain fully legally accountable under Law No. 23 of 2011 and Government Regulation No. 14 of 2014. Such accountability encompasses administrative, moral, and social responsibilities. The lack of technical regulations concerning digital zakat transaction mechanisms and standardized reporting indicates weak institutional accountability, potentially undermining public trust in digital zakat practices. Therefore, a regulatory framework is urgently needed one that accomodates digital innovation while ensuring transparency and accountability in accordance with sharia principle.
