Abstract

Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana pengaturan sewa menyewa menurut Undang-Undang Nomor 1 Tahun 2011 tentang perumahan dan kawasan pemukiman dan bagaimana mengatasi menguasai rumah sewa tanpa hak. Dengan menggunakan metode penelitian yuridis normatif, disimpulkan: 1. Undang-undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman mengatur tentang kewajiban pemerintah dalam menyelesaikan permasalahan yang ditimbulkan dari sewa-menyewa.  Pasal 147 dan Pasal 148 menjelaskan tentang tata cara penyelesaian permasalahan yang timbul dari sewa-menyewa tersebut. Dan dalam Pasal 152 menjelaskan tentang pemberian sanksi pidana terhadap si penyewa apabila melanggar perjanjian yang telah di buat atas dasar sewa-menyewa atau perbuatan yang melanggar Pasal 136 Undang-undang No. 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman. 2. Penempatan atau menguasai rumah sewa tanpa hak sebagaimana yang diatur oleh Peraturan Pemerintah Nomor 44 Tahun 1994 tentang Penghunian Rumah Bukan oleh Pemilik diatur juga dalam Peraturan Pelaksanaan yang melengkapi UU tersebut di atas dalam Pasal 10 ayat 2 nya dijelaskan bahwa perjanjian sewa yang sudah sampai pada batas waktunya dan penghunian dinyatakan tidak sah, maka pemilik atau si pelapor dapat meminta bantuan kepada POLRI untuk segera mengosongkannya sekaligus polisi mempunyai kewajiban untuk menyidik dan melimpahkan perkara pidana tersebut kepada pihak kejaksaan untuk diajukan penuntutan kepengadilan.Kata kunci: Pengaturan, Sewa Menyewa, Perumahan dan Kawasan Pemukiman

Abstract

This research aims to find out whether Korea violates the provisions of International trade Article III: 2 First sentence and second sentence of GATT in 1994. Soju is a traditional alcoholic beverage that is most famous in Korea has been produced in a diluted manner so that the beverage content of 25% alcoholic soju can be said that the beverage has a content that is below 20%. But people in European countries and the United States have complaints or opinions that they do not agree with the alcohol tax policy in South Korea, especially soju is considered unfair. So Korea is trying to offer a preference for taxes on soju drinks compared to certain imported western-style drinks. The research conclusions show that Soju and Imported Liquor Spirits are not substitutive products. Soju and Imported Liquor Spirits do not compete directly, seen from the fact that although there has been a decrease in the number of Soju sales in Korea since the ILS tax was lowered, the distance between Soju and ILS sales is still far away. So from the facts above, South Korea does not violate GATT Article III: 2 Second Sentence. From our explanation above, Like Products is a cumulative requirement to meet: Common Characteristics End Uses Channels of distribution Prices. From that data, South Korea does not violate GATT Article III: 2 First Sentence and Second Sentence although there are differences in tax imposition because the two products, Soju and ILS are not like products. Abstract

This research aims to examine granting discretion to government officials or state administration is a logical consequence of the welfare state's conception. This opens up opportunities for officials to commit corruption. Based on the administrative law, state officials' abuse of power is not a criminal offence but purely the administration's fault. However, with the issuance of the Government Administration Law, court judges from Corruption Crime have their right to judge whether there is an element of abusing their authority or not. Better laws and no negative impact or a growing number of problems. Evaluation and updating must be carried out to obtain maximum results and satisfy all parties. The first method employs in this research was the statute approach or the statutory approach. The second method used was a conceptual approach. The data collection used in this article is secondary data collection by finding and collecting data that has already been published in books, newspapers, magazines, journals, online portals regarding this issue. The result is there are still problems arising from the enactment of Law Number 30 of 2014, especially on constitutional grounds, State Administrative Courts, and Corruption based on discretion. Several journals and studies have been conducted to corroborate this question. Therefore, it is necessary to make adjustments and improvements in several areas to obtain a better law and does not cause adverse impacts or a growing number of problems.
