Abstract

This paper aims to describe how the construction of a peace culture in the brotherhood relations of gandong Booi, Aboru, Kariu, Hualoy (BAKH) through their involvement in building mosques and churches. This paper uses a qualitative method by relying on in-depth interviews through key informants selected intentionally (purposively), namely key actors in the community in the four BAKH countries and people involved in the BAKH organization. This paper shows that the worst humanitarian conflict in the history of the Moluccans did not necessarily destroy the traditional identity of the Moluccans, but instead emphasized the strong ties of adat and religion in the practice of Pela Gandong fraternity. This article emphasizes the importance of building a peace process through a cultural base that structurally influences the fundamental agent of local wisdom Pela Gandong. The construction of the peaceful cultural values of the Maluku people, thus requires the strengthening of the Pela Gandong traditional institutions in the midst of rapid social change.Key Word: Construction, Peace Culture, Gandong BAKH, Identity of culture and religion

Abstract

This research aims to explore the construction of a culture of peace in kinship relations (gandong) among the villages of Booi, Aboru, Kariu, and Hualoy (BAKH), Christian-Muslim communities, which have a culture-brotherhood narrative. Located on various islands in Central Maluku, these villages preserve the narrative of culture-brotherhood as the basis of social and religious life. Embracing different religious beliefs, the four villages celebrate cultural-kinship ties through religious symbols: churches and mosques. In 1971, the four villages built a mosque in Hualoy, a Muslim village. Even though the three have different religious beliefs, this mosque is classified as a mosque with BAKH. In the midst of the 1999 – 2004 Maluku conflict which turned Ambon, the capital of Maluku Province, into social segregation, the four villages rebuilt the Kariu church, a Christian village in 2017. Support for the construction of this church came from BAKH residents in Maluku and the diaspora. Using ethnographic methods, this research investigates the cultural narrative behind the performativity of Christians-Muslims involved in previous conflicts, but collectively rebuilding religious holy places. This research concludes that kinship cultural relationships, performative actions and shared symbols contribute to the peace building process in the post-conflict region, Maluku.Keywords: Construction, Culture of Peace, Collaboration with BAKH, Cultural and Religious Identity

Abstract

This research examines the application of Islamic criminal law in addressing the negative impacts of online gambling on society, both socially and economically. The main objective of this study is to analyze the effectiveness of applying Islamic criminal law in dealing with the negative impacts caused by online gambling through a normative juridical approach. The method used is normative juridical, examining laws and regulations, fatwas, and the principles of Islamic criminal law relevant to online gambling issues. The findings show that although Islamic criminal law is firm on gambling, its application within Indonesia's positive law has not been fully effective in mitigating the negative impacts of online gambling. In conclusion, the application of Islamic criminal law can be an alternative solution to address the negative impacts of online gambling, but it requires harmonization with the prevailing positive law in Indonesia. Additionally, preventive efforts from the government and society are necessary to prevent the spread of online gambling.
