Abstract

Abstract: The Role of Notary in Business Agreement Practices in the Islamic Bankings ( A Review from the perspectives of Islamic Economics Law). Notary is a public official who is authorized to make authentic acts on all deeds, agreements, and provisions required by a general regulation or desired by the parties to be declared in an authentic deed. Notary occupies a very important position in the sharia banking industry especially in the making of authentic deed relating to agreements/contracts and binding guarantee. The function of the authentic deed is as an evidence having the force of law (volledig bewijs). In the perspective of Islamic economics law, an authentic deed is similar to a treaty or an engagement in general, that is an agreement (contract) that occurred between the two sides to make an offer and acceptance (Ijab-Qabul) regarding a particular thing.Keywords: notary, authentic deed, Islamic economics law Abstrak: Peran Notaris dalam Praktik Perjanjian Bisnis di Perbankan Syariah (Tinjauan dari Perpektif Hukum Ekonomi Syariah). Notaris merupakan pejabat umum yang berwenang untuk membuat akta otentik mengenai semua perbuatan, perjanjian, dan penetapan yang diharuskan oleh suatu peraturan umum atau yang dikehendaki oleh para fihak untuk dinyatakan dalam suatu akta autentik. Notaris menduduki posisi yang sangat penting dalam industri perbankan syariah, terutama dalam pembuatan akta-akta otentik yang berkenaan dengan perjanjian-perjanjian atau kontrak-kontrak dan pengikatan jaminan. Fungsi dari akta otentik yang dibuat oleh Notaris dapat menjadi alat bukti yang memiliki kekuatan hukum sempurna (volledig bewijs). Dalam hukum ekonomi syariah, akta otentik yang dibuat oleh Notaris sama dengan perjanjian atau perikatan dalam sebuah akta pada umumnya, yakni perjanjian (akad) yang terjadi antara dua belah pihak berdasarkan kesepakatan keduanya untuk melakukan penawaran dan penerimaan (Ijâb-Qâbul) mengenai suatu obyek.Kata Kunci: notaris, akta otentik, perbankan Islam

Abstract

This paper is motivated by the role of the university legal clinic under the spirit of implementing the third of university role in the field of community service. In practice, legal aid services at universities are not different from general aid agencies in general. One of the uniqueness of the university legal clinic program is the direct involvement of student paralegal in helping the clients to get legal aid services within the university and court. The student paralegal encounters various opportunities and challenges. The main opportunities, they have their passion and strong motivation to become justice fighters for justice seekers, while they have also the main challenges such as limited time, facilities, knowledge, and legal skills. However, the existence of student paralegal has proven to be very helpful for the clients not only in processing applications and registering cases in court but also in assisting clients in the form of consultation and legal assistance during non-litigation and litigation. Therefore, the university legal clinic program needs to be further strengthened and developed at PTKIN because it has proven positive implications for helping underprivileged people and justice seekers to get access to justice.
