Abstract

Artikel ini menganalisis dinamika kepentingan ekonomi politik yang melatarbelakangi lahirnya UU Perindustrian dibawah periode kekuasaan rezim Orde Baru. Dengan menggunakan penelusuran historis, artikel ini berpendapat bahwa pembentukan UU Perindustrian tidak dapat dilepaskan dari pentingnya sektor perindustrian sebagai arena pertarungan yang kompleks yang melibatkan berbagai kepentingan kelas penguasa, pemikiran teknokrat serta elite kongsi bisnis. Konfigurasi politik, perbedaan preferensi ideologis dan perubahan sosial yang berlangsung di masa Orde Baru sangat menentukan arah politik hukum UU Perindustrian untuk menciptakan kondisi-kondisi yang memungkinkan industri dalam negeri dapat mandiri dalam memperluas kegiatan industrinya serta mengurangi ketergantungan Indonesia akan investasi asing.

Abstract

The emergence of World Bank legal reform projects in promoting the rule of law has been successful to encourage third world countries to reform their legal aspects to help formulate market friendly policy. This article tries to question the concept of rule of law that is materialized in many World Bank legal reform projects by using critical legal perspective to analysis legal scholarship on the role of law in the context of development. It trying to present an alternative explanation of World Bank’s rule of law which we are hypothetizing as a neoliberal concept. World Bank’s rule of law are nothing more than a formalistic and limitative concept which is constituted by abstract and universal rules such as protection of private property, contract enforcements and operational efficiency which is a legal framework to easify capitalism. This article conclude that World Bank’s rule of law are bereft of emancipatory values and only serves as a tool for neoliberal penetration to third world countries.

Abstract

The increasing trend of constitutional reform in the global South for the last three decades has marked a shift from the state interventionism regime to free market neoliberalism. This article explores the concept of new constitutionalism which has been used in comparative constitutional law studies to understand the adoption of neoliberal legal norms through constitutional reform. It argues that the constitutionalization of neoliberal features cannot be separated from the context of the global imperialism hegemony which has an interest to establish a market-friendly legal framework in global South. Incorporating neoliberal legal norms into the economic constitution at the national level offers an effective way to lock in neoliberal value as a normative order for the state institutions and therefore, that place limitation of state intervention toward market.
