Abstract

The subject raised in this thesis is the existence of a secret marriage but filing for divorce in the Religious Court. The judge uses Article 7 paragraph (3) letter a of the Islamic Law Compilation as a consideration to prove the marriage. This research analyzes the case number 7073/Pdt.G/2021/PA.Kab.Mlg regarding the consolidation of proving marriage and divorce according to positive law in Indonesia. The research method used is empirical research method through interviews and observations at the District Court of Malang with descriptive, evaluative, and prescriptive data analysis. The researcher analyzes the verdict number 7073/Pdt.Kab.G/2021/PA.Mlg using the Legal Ethical Theory, which indicates that the use of Article 7 (3) letter (a) of the Islamic Law Compilation is questionable in terms of legal interpretation when compared to applicable laws and regulations. However, despite this, the case remains valid, but legal certainty in case administration cannot be achieved.

Abstract

Terdapat sejumlah persoalan yang muncul dalam penerapan skema bangun guna serah, seperti jangka waktu pengelolaan, penyewaan ulang aset kepada pihak ketiga, dan penggunaan BMD yang tidak sesuai ketentuan. Pemerintah Kabupaten Jombang masih menggunakan cara-cara konvensional dalam pemanfaatan BMD, padahal telah ada regulasi yang lebih modern seperti PERPRES No. 38/2015 tentang Kerjasama Pemerintah dengan Badan Usaha (KPBU). Penelitian ini menggunakan metode penelitian yuridis empiris dengan pendekatan konseptual. Sebagaimana yang telah disampaikan oleh Bagian Hukum Pemkab Jombang bahwa implementasi dari pelaksanaan BGS maupun kebijakannya masih banyak resiko sebagaimana peristiwa-peristiwa BGS yang terjadi di Jombang yang sampai saat ini belum juga terselesaikan dengan baik. Dari beberapa upaya-upaya yang sudah dilakukan oleh Pemerintah Kabupaten Jombang untuk meningkatkan implementasi kebijakan infrastruktur pembangunan yang menggunakan skema alternatif pembiayaan PPP dalam hal ini BGS, tentunya juga harus memperhatikan ketentuan-ketentuan yang berlaku dan telah ada, karena itu perlu adanya upaya dan inovasi kebijakan pemerintah.

Abstract

This regency, which has an icon of a city of Islamic boarding school students, was in the spotlight in early 2025 due to the murder and rape of a minor in Sebani Village, Sumobito District. Brudu Village, as a neighboring village, must be responsive to prevent similar incidents from occurring in its village. This response must be addressed by the Brudu Village Government in terms of increasing understanding of reproductive health for adolescents and creating a process for handling problems. The methods used in this community service were carried out through counseling and legal consultations, as well as legal assistance based on the consultation results. The results of this service found that so far the Brudu village community does not understand the law on reproductive health for adolescents, this is indicated by the average 56% of Brudu residents do not know reproductive health for adolescents, especially the process of handling (87%) and rights (56%) regulated in the regulations. The implications of this low understanding, so the community service team provided assistance to the village government and village midwives to establish a standard operating procedure containing a flow of promotive, preventive efforts, and handling of reproductive health problems.
