Abstract

The challenges of national development related to employment have increased with the presence of free trade and industrial globalization, the presence of foreign workers is a necessity and an unavoidable challenge. The presence of foreign workers will have an impact on the absorption of local workers. The purpose of this research is to find out the supervision of foreign workers by the Office of Transmigration and Manpower in Central Aceh District. This type of research is empirical juridical, using primary data sources and secondary data. The method of data collection is done by interviews and document studies. The results of the study show that supervision of foreign workers by the Transmigration and Manpower Office in Central Aceh District is only limited to monitoring Permits to Employ Foreign Workers (IMTA) for each foreign worker employed by the company concerned. Furthermore, the authority to supervise and enforce foreign workers (TKA) is the authority of labor inspectors at the Aceh province manpower service as stipulated in Appendix letter G of Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government .

Abstract

The role of correctional institutions is very important in carrying out services and fulfilling the rights of convicts, including in terms of fulfilling the right to special treatment for elderly convicts. The purpose of this research is to find out the fulfillment of the right to special treatment for elderly convicts in terms of safety and health protection at the Class II B State Detention Center in Takengon. This type of research is empirical juridical research using data sources in the form of primary data obtained from the field directly through interviews and secondary data obtained from primary legal materials, secondary legal materials, tertiary legal materials. The method of data collection was carried out by direct interviews with sources and document studies. The method of data analysis was analyzed qualitatively and presented in a descriptive manner, namely explaining, describing, and describing in accordance with the problems that are closely related to this research. II B Takengon, it has been implemented in accordance with the applicable regulations, namely Article 6 paragraph (1) and Article 7 paragraph (1) of the Minister of Law and Human Rights Regulation Number 32 of 2018 concerning Treatment of Elderly Detainees and Convicts.

Abstract

Perkembangannya dewasa ini, masih sering dijumpai pelanggaran-pelanggaran terhadap hak seseorang di bidang kesehatan. Salah satu hal yang aktual adalah pola hidup masyarakat Indonesia dalam kegiatan merokok. Sanksi pidana yang dapat dijatuhkan bagi pelanggar yaitu diancam dengan pidana kurungan paling lama 3 bulan dan/atau denda setinggi-tingginya Rp. 50.000.000,- (lima puluh juta rupiah). Tujuan dari dilakukannya penelitian ini, untuk mengetahui penerapan pidana terhadap pelanggaran Qanun Kawasan Tanpa Rokok Dan Kawasan Terbatas Rokok, dan untuk mengetahui faktor penghambat penerapan pidana terhadap pelanggaran Qanun Aceh Tengah tentang Kawasan Tanpa Rokok Dan Kawasan Terbatas Rokok. Jenis Penelitian adalah yuridis empiris, yaitu cara yang digunakan untuk memecahkan masalah penelitian dengan meneliti data primer terlebih dahulu, kemudian dilanjutkan dengan meneliti data sekunder. Hasil penelitian menjelaskan bahwa penerapan pidana terhadap pelanggaran Qanun Kawasan Tanpa Rokok Dan Kawasan Terbatas Rokok, sejauh ini belum diterapkan hanya sebatas diberikan peringatan dan himbauan agar tidak merokok di kawasan-kawasan yang dilarang untuk merokok, sedangkan faktor penghambat penerapan pidana antara lain dikarenakan kurangnya sosialisasi kepada masyarakat, faktor aparat penegak hukum, faktor sarana atau fasiltas yang mendukung, kurangnya kesadaran hukum pegawai pemerintah daerah.
