Abstract

Choice of law is one of the clauses in contracts that arise due to economic globalization. The use of this choice of law has led to the question of which forum has the right to resolve disputes if the agreement does not include a choice of forum. This research will analyze the jurisdiction of which court has the authority to adjudicate when the contract is subject to foreign law and the legal consequences if there is a choice of foreign law. The method used in this research is normative juridical with an emphasis on literature study. The results of this study concluded that the Central Jakarta District Court is not authorized to adjudicate disputes in which the agreement chooses English law as the choice of law because England uses a common law legal system which defines the choice of law as well as the choice of forum so that the settlement of the case must be carried out in the English Court. The legal consequences arising from the making of a contract that is subject to foreign law are the rights and obligations that are regulated in accordance with the chosen law.

Abstract

BPJS Kesehatan adalah lembaga negara yang bertugas menjalankan program jaminan kesehatan nasional bagi seluruh masyarakat Indonesia. Meskipun BPJS Kesehatan berperan dalam memberikan pelayanan kesehatan, dalam pelaksanaannya, masih terdapat beberapa kendala. Salah satunya adalah keluhan dari peserta BPJS Kesehatan mengenai pengadaan obat pada fasilitas kesehatan. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menunjukan bahwa Puskesmas sebagai bagian dari upaya kesehatan menyelenggarakan layanan kesehatan yang mengutamakan promotif dan preventif untuk mencapai derajat kesehatan yang seitinggi tingginya puskesmas diharapkan tidak mengesampingkan pemberian jaminan pelayanan kesehatan kuratif serta rehabilitatif pada seluruh masyarakat yang membutuhkan serta dapat selalu memastikan pemberian dan pengadaan obat untuk peserta BPJS Kesehatan dapat optimal. Akibat hukum yang dapat terjadi pada kasus ini mencakup ketentuan Pasal 1365 KUHPerdata tentang perbuatan melawan hukum. Dalam hukum perdata, sanksi yang dapat diterapkan berupa ganti kerugian yang diberikan oleh BPJS Kesehatan atau fasilitas kesehatan kepada pasien yang dirugikan, seperti pengembalian uang, penggantian barang dan/atau jasa, perawatan kesehatan, atau pemberian santunan.BPJS Kesehatan, sebagai lembaga negara yang bertanggung jawab menjalankan program jaminan kesehatan membentuk unit pengaduan untuk masyarakat. Salah satu programya adalah BPJS SATU (Siap Membantu). Jika masalah tidak dapat diselesaikan melalui unit pengaduan, proses penyelesaian selanjutnya melalui mediasi, dan BPJS Kesehatan bertanggung jawab untuk membantu proses tersebut sebagai mediator.

Abstract

This research aims to analyze the sandbox as a legal instrument for development of financial sector technology innovation in Indonesia. This research endeavors to answer the following questions what is the mechanism of sandbox as a legal instrument for development of financial sector technology innovation in Indonesia, and What are the challenges of Sandbox as a legal instrument for development of financial sector technology innovation in Indonesia. The research method is Normative juridical. The research concludes the stipulation of OJK Regulation Number 3/2024 On The implementation Of Financial Sector Technology Innovation (ITSK) have several changes namely the scope of the financial sector technology innovation not only digital ecosystem but also conventional financial services institutions, the sharia financial services sector, the legal protection and legal certainty for consumers, asset crypto etc (Artikel 1).The determination of the result feasibility sandbox trial has an impact to create participants' perceptions of the feasibility model standards that appropriate to the innovation criteria according to the OJK. The criteria is a form of OJK recognition of the innovation criteria that must be carried out participant sandbox. This condition certainly provides clarification to other participants related to the innovation criteria implemented by the OJK as stated in SEOJK No. 5 of 2024. Furthermore, the ability of government to formulate sandbox legal instruments should be supported by the availability of competent and competitive human resources related to developing digital financial economy products, services and business models that appropriate to face the challenges and market needs of the financial services sector in Indonesia

Abstract

The creative economy has grown rapidly in recent years. Indonesia has published Government Regulation Number 24 Year 2022 concerning Implementing Regulations for the Creative Economy, which is expected to be able to realize the hopes of many entrepreneurs in the creative economy to gain access bank credit based on intellectual property. Bank credit guarantees are based on intellectual property and are a breakthrough in creative economy industry, but these regulations give rise to complex problems because the assets being guaranteed, namely intellectual property rights, are intangible assets, so there are concerns that banks will not accept them as credit providers. In addition, the time period for intellectual property protection is limited and there is no organization in place to evaluate intellectual property assets in Indonesia that can be used as credit collateral. The problem approach method used is the empirical juridical method. This research discusses financing based on intellectual property rights schemes and the obstacles or challenges faced by the banking industry with this financing based on intellectual property rights. The implementation on Creative Economy Government Regulation still has many obstacles in its implementation. It can be seen from many things have not been regulated clearly and in detail, for example regarding the form of Intellectual Property Rights credit collateral binding have not been clearly regulated, Intellectual Property Rights valuation mechanism and the appraisal team, execution techniques, secondary market is not available to facilitate execution. The lack of clear regulations has resulted in concerns from banking institutions about channeling credit to the creative economy because it is considered to be high risk.
