Abstract

The constitution is supreme because it is assumed as a form of agreement of all people. Indonesia adheres to the supreme constitution and the understanding of democracy, so that every policy whether it is a product of legislation or other political policies must be in accordance with the values โ€‹โ€‹of society or in accordance with the wishes of its people. The authority of the President as the holder of government power is not unlimited power, but has guiding principles in making specific policies regarding the formation of the Presidential Work Unit. These rules must be in line with the constitution and democracy (constitutional democracy). Institutional relations between the President's Work Unit for Development Supervision and Control with the Ministry of State, Cabinet Secretariat as well as between the Legal Mafia Eradication Task Force and law enforcement agencies such as the Corruption Eradication Commission, the Police, and the Prosecutors' Office, have the potential for overlapping authorities in the practice of implementing government and law enforcement.

Abstract

Indonesia as one of the countries that adheres to a democratic system. The system of government is organized by the people, by the people, and for the people. Indonesia in the course of democracy underwent several periods, until now undergoing a period of reform. The diversity of the Indonesian people is a factor that greatly influences the birth of political parties and encourages the formation of a multiparty system in Indonesia. Democratic countries, of course, justify the existence of political parties as pillars of democracy or the exercise of popular sovereignty. Democracy is carried out through general elections in the context of occupying the leadership and power seats in which political parties are participants.

Abstract

Regional original income is an indicator of regional independence in terms of finance. The greater the revenue and the percentage of original regional revenue (PAD) to the total regional revenue, the more independent the region is. The formulation of the problem whether the contribution of Motor Vehicle Tax (PKB) and Motor Vehicle Title Fee Tax (BBNKB) has an effect on Regional Original Income (PAD). Motorized Vehicle Tax (PKB) and Motor Vehicle Transfer Fee Tax (BBNKB) have a significant effect on Regional Original Income (PAD). Local taxes are an important source of regional income to finance development and regional governance. Regional tax policies are based on the principles of democracy, equity and justice, community participation and accountability with due regard to regional potential. With the enactment of regional regulations relating to taxes, the ability of regions to finance their expenditure needs will increase, because regions can easily adjust their income. The government is expected to be able to maintain and make more efforts to increase Motor Vehicle Tax revenue, it is necessary to have firm sanctions and improve the existing administrative system.

Freies Ermessen is a freedom given to state administration in the context of administering government. So that Freies Ermessen is the freedom to act on its own initiative and policy from the state administration. In line with the increasing demands for public services that must be provided by State administration for the increasingly complex socio-economic life of citizens, however, the use of Freies Ermessen must not conflict with applicable law, both written law and unwritten law.

Abstract

ABSTRAK Negara Indonesia adalah Negara kesatuan yang berbentuk Republik. Pasal 18 ayat (5) UUD 1945 menegaskan bahwa, Pemerintah menjalankan otonomi seluas-luasnya, kecuali urusan pemerintahan yang oleh undang-undang ditentukan sebagai urusan pemerintah pusat. Pemberian otonomi merupakan penjabaran prinsip bahwa pemerintah pusat berwenang secara lebih intensif terhadap persoalan-persoalan di daerah. Jenis penelitian ini merupakan penelitian hukum normatif, dengan data utama penelitian adalah data sekunder yaitu data yang diperoleh dari studi kepustakaan. Bahan hukum yang digunakan adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian dapat diketahui bahwa Otonomi Daerah yang digunakan di Indonesia sejak kemerdekaan Negara Indonesia Tahun 1945 sampai dengan pasca amandement UUD 1945.Kebijakan otonomi daerah dilakukan dengan mendesentralisasikan kewenangan yang selama ini tersentralisasi di tangan pemerintah pusat. Dalam proses desentralisasi itu, kekuasaan pemerintahan pusat dialihkan dari tingkat pusat ke pemerintahan daerah sebagaimana mestinya, sehingga terwujud pergeseran kekuasaan dari pusat ke daerah kabupaten dan kota di seluruh Indonesia. Agar tidak menjadi pemerintahan yang sentralistik, hendaknya dilakukan pembatasan-pembatasan tertentu dalam hal memproduk perundang-undangan yang menyangkut kepentingan atau kewenangan urusan derah. Undang โ€“ Undang Dasar 1945 seharusnya mengatur otonomi daerah secara konsekuen dalam arti tidak mencampuradukan antara ciri/karakter negara federal dan ciri/karakter negara kesatuan. Hal ini berdampak terjadinya ketidak sinskronan dan ketidak konsistenan pengaturan kewenangan urusan pusat dan daerah. Kata Kunci : OtonomiPascaAmandemen Abstract The State of Indonesia is a unitary state in the form of a republic. Article 18 paragraph (5) of the 1945 Constitution confirms that the Government shall exercise the widest possible autonomy, except for government affairs which are determined by law to be the affairs of the central government. The granting of autonomy is an elaboration of the principle that the central government has more intensive authority over problems in the regions. This type of research is normative legal research, with the main research data being secondary data, namely data obtained from library studies. The legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The results of the study can be seen that Regional Autonomy has been used in Indonesia since the independence of the State of Indonesia in 1945 until after the amendment to the 1945 Constitution. Regional autonomy policy is carried out by decentralizing authority which has been centralized in the hands of the central government. In the decentralization process, the power of the central government was transferred from the central level to the local government as it should be, resulting in a shift of power from the center to districts and cities throughout Indonesia. In order not to become a centralized government, certain restrictions should be put in place in terms of producing legislation concerning the interests or authorities of regional affairs. The 1945 Constitution should consistently regulate regional autonomy in the sense of not mixing up the characteristics of a federal state and the characteristics of a unitary state. This has resulted in a lack of synchronicity and inconsistency in the regulation of central and regional affairs authority.

Abstract

This research uas used normative jusdical about Constitutional Court Judges to be respectfully dismissed according to Law No. 7 of 2020 concerning the Constitutional Court and what is the legal meaning of Constitutional Court Decisions which are Final and Binding. The results of research on the dismissal of constitutional judges in Law 24/2003 as amended into Law Number 7 of 2020 concerning the Constitutional Court Become a Law and in more detail regulated in Constitutional Court Regulation Number 4 of 2012 concerning rocedures for Dismissing Constitutional Judges ("PMK 4 /2012โ€). Constitutional judges are honorably dismissed for the following reasons: death, resignation at their own request submitted to the Chief Justice of the Constitutional Court, being 70 (seventy) years old; removed; or, hysical or mental illness continuously for 3 (three) months so that he cannot carry out his duties as proven by a doctor's certificate. The decision of the Constitutional Court, which is final and binding, contains 4 (four) legal meanings, namely: First, to create legal certainty as soon as possible for the parties to the dispute. Second, the existence of the Constitutional Court as a Constitutional Court. Third, it is meaningful as a form of social control carried out by the Court. Fourth, as the sole guardian and interpreter of the constitution.

Abstract

This study focuses on the Public Works and Spatial Planning Office's role in the existing Spatial Planning Regional Regulation in Asahan Regency, especially in its amendments. The changes are intended to harmonize, synchronize and harmonize the spatial planning regulations that the Regional Government of North Sumatra Province has issued. The research method used is the empirical method, considering the Settlement of the Formation of the Civil Code, and the empirically symptomatic law. These, namely various legal factors influence it, so the study will lead to the role of organizations and legal institutions when enforcing the law. The results show that changes to the Asahan District Civil Code have been implemented based on the proposals from the PUPR Service so that the role of the PPUPR Office has been achieved, namely planning, informative, and indicative. For implementation, there are also obstacles encountered, such as the limited budget ceiling, the issuance of changes to the Procedure for the Implementation of Strategic Environmental Studies (KLHS), the limited number of employees in the field of spatial planning who have spatial planning legal competence and the lack of financial support for education and training in the field of spatial planning by local governments.

Abstract

The Steering Element in the Regional Disaster Management Agency (BPBD) is an important organ that must exist, where one of its tasks is to provide input in the form of suggestions to the BPBD Leadership as a derivative of the National Disaster Management Agency (BNPB) in the regions. The absence of a Directing Element organ in BPBD will have no impact walking BPBD functions optimally and violates existing provisions. The existence of a Steering Element is very important, where the input provided is related to strategies, plans and evaluations at BPBD, where the Steering Element consists of employees from Government Agencies and those from Professional/Expert Societies. Empirical research is used due to the potential gap between Das Sollen and Sein , namely there is a gap between existing regulations and the existing situation. The type of field research referred to is obtaining data from research field directly which is the result become objective from research This that is Having a Steering Element in BPBD Asahan is an important and urgent matter. The result form found there are obstacles in implementation is one of them because mechanism the determination is assessed eat time so that needed seriousness as well as support budget from since start of the registration process until financing in implementation his job. The conclusion is that the existence of a Steering Element in the BPBD in Asahan is important and immediate actualization and existence This steering element must also be complemented by legal regulations at the level Regional District .
