Abstract

This paper discusses the main problems in handling disputes over the abuse of authority by state officials. This paper is based on the concept of the state as an organization or the highest body that has the authority to regulate matters relating to the interests of the wider community and has the obligation to prosper, protect and educate the life of the nation. This paper aims to analyze the Authority of Government Officials in carrying out Government and the Settlement of Abuse of Authority within the scope of Government Officials. This paper confirms that the issuance of Law Number 30 of 2014 concerning Government Administration is a response and response to the polemic surrounding which judicial institution has the competence to examine whether or not there is an alleged element of abuse of authority by a public official. The law expressly mandates the state administrative court as a judicial institution that has absolute competence to examine the alleged abuse of authority. The presence or absence of an element of abuse of authority must be tested with the principle of specialism (specialiteitsbeginsel) which is nothing but the domain of administrative law. The Decision of the State Administrative Court in resolving the abuse of authority carried out by the Agency and / or Government Official that harms the state finances as stipulated in Law No. 30 of 2014, has binding legal force and must be obeyed and implemented by the relevant Government Officials.

Abstract

One of the most important parts of the constitutional legal system is that each state entity has an equal amount of power. In a democratic government, this balance of power is kept in large part by the legislature. But many things can affect how well the legislature does its job and how it keeps the balance of power in the constitutional law system. The goal of this study is to look at how the government keeps the balance of power in a constitutional legal system. This study uses a normative legal method to look at the role of the legislature in making sure that other state institutions have the same amount of power. The study's results show that the legislature's job is to keep the balance of power in the constitutional legal system. This is done by making laws, keeping an eye on things, asking questions, and giving views. But there are things that make it hard for the legislature to do its job, like the system and process of checks and balances in the Constitution as it was changed in 1945. In theory, having the Constitution of 1945 is no longer enough to make it a constitutional document that can bridge and protect all of the state's democratic processes. So, work needs to be done to improve the legislature's institutional role in keeping the balance of power in the constitutional judicial system.

Abstract

Adapun yang menjadi tujuan penelitian dalam penelitian ini yaitu untuk mengetahui aspek geopolitik dan geostrategi pemidahan ibu kota negara. Jenis penelitian yang digunakan yaitu penelitian yuridis normatif yang dimaksudkan sebagai suatu peneilitian dasar guna menemukenali bagaimana terjadinya suatu peristiwa atau masalah tertentu yakni berhubungan dengan masalah hukum. Pertimbangan geopolitik dan geostrategis juga dapat digunakan untuk memastikan bahwa pemindahan ibu kota negara didasarkan pada penyelidikan yang menyeluruh. Sebenarnya, geopolitik adalah bidang keilmuan yang melihat sistem politik yang terikat pada tempat Anda berada. Akibatnya, geopolitik juga dapat dipahami sebagai sistem politik atau regulasi berupa kebijakan dan strategi nasional yang dipengaruhi oleh letak suatu negara. Setiap negara, termasuk Indonesia, mengharapkan Urusan Internasional untuk memutuskan kerangka perbaikan politik publik, yang bergantung pada situasi dan kondisi geologis dalam mencapai tujuan negara. Akibatnya, geografi kepulauan Indonesia dikenal sebagai Wawasan Nusantara.
