Abstract

Pelanggaran hak cipta terkait internet dan teknologi digital semakin meningkat di Indonesia. Distribusi ilegal konten yang dilindungi hak cipta menjadi lebih mudah dan cepat, terutama di media digital seperti buku, lagu/musik, sinematografi, dan perangkat lunak. Pelanggaran juga terjadi pada penerjemahan dan pengunggahan tidak resmi ke situs atau platform yang dapat dinikmati masyarakat secara gratis atau berbayar. Langkah konkrit peningkatan pengawasan dan penegakan hukum antara lain dengan memperkuat lembaga perlindungan hak cipta dan pengelolaan hak-hak tersebut oleh Lembaga Manajemen Kolektif (LMK). Langkah tersebut diharapkan dapat menjaga keberlangsungan industri kreatif.

Abstract

The plurality of religions in Indonesia presents significant challenges to the multidimensional implementation of the existing inheritance law. A particularly complex issue arises when heirs hold differing religious beliefs, which may occur due to interfaith marriages among their parents or individual conversions by the heirs themselves. This divergence in faith introduces a dualism of norms, as it contrasts the exclusive normative provisions of Islamic law with the inclusive approach espoused by Indonesian positive law, which seeks to promote substantive justice. This current research aims to investigate juridical disparities within interfaith inheritance law through a normative and comparative juridical approach. The findings suggest that the absence of an integrated legal framework leads to legal uncertainty, creating interpretative gaps that adversely affect individual civil rights. Consequently, this research advocates for the reformulation of national inheritance law arrangements and policies, emphasizing a foundation of sustainable and equitable legal pluralism.

Abstract

This study is entitled “Disparities in the Authority to File for Bankruptcy and PKPU after the Enactment of Law Number 1 of 2025 concerning State-Owned Enterprises: A Critical Study of the Position and Article 2 Paragraph (5) of the Bankruptcy and PKPU Law”. This study was motivated by the strengthening of the state's role in the management of State-Owned Enterprises (SOEs) after the enactment of the 2025 SOE Law, which allows the state to have greater control over the financial management and debt restructuring of SOEs. The research method used is normative legal research, with a statute approach, case approach, and conceptual approach. Data collection techniques were carried out through library research with primary legal materials in the form of the 2025 SOE Law, Law No. 37 of 2004 concerning Bankruptcy and PKPU, as well as related court decisions; secondary legal materials in the form of books, scientific journals, academic articles, and previous research. The analysis was conducted using a prescriptive-analytical qualitative approach to assess legal norms and legal policy implications in depth. The results of the study show that after the 2025 SOE Law, there is a significant disparity in authority between SOEs and private creditors, whereby the filing of bankruptcy and PKPU petitions has become more dependent on state approval. This creates legal uncertainty for creditors, potential moral hazard incentives for SOE managers, and the risk of undermining the principles of equality before the law and fair business competition. In terms of legal politics, state dominance can lead to a shift in interests from private rights to national stability, which requires transparent mechanisms and clear legal procedures. The conclusion of this study emphasizes that the legal treatment of SOEs must be proportional, maintaining a balance between public interests and private creditor rights, and minimizing legal and market distortions. This study presents a new perspective on the long-term implications of the 2025 SOE Law on the bankruptcy and PKPU systems, which is an important contribution to Indonesian economic law literature.

Abstract

The technological transformation in the digital era has changed the paradigm of the banking world. Financial access is now inseparable from space, distance, and time, as it only requires the internet and sophisticated devices for every customer to make transactions. On the other hand, cyber security of customer data and funds is very risky to be hacked with various instruments and methods such as fishing, spam, ransomware to cause material losses, historically cyber attacks have been experienced by Bank Indonesia on January 21, 2022, Bank BSI May 2023 and most recently Bank BRI on December 18, 2024, but not transparently impacting customers. Customer protection is based on the regulation of Law Number 1 of 2024 concerning Electronic Information and Transactions and does not specifically regulate the protection of customer data and funds. The purpose of the research focuses on the practical order of cyber regulation in protecting customer data and funds, and the reactualization of the provisions of laws and regulations. The research method was carried out with normative juridical analysis with qualitative normative data analysis. The results of the study show first, the actual condition of cyber security today through the provisions of the ITE law has not been carried out comprehensively verified in the context of law enforcement the evidentiary instruments are inadequate, the jurisdiction of the authority limits the accessibility of cyber security law enforcement, there has been no case of buying and selling bank customer data that has been punished in the second court, the reactualization of cyber security data and funds can be carried out by strengthening the evidentiary instruments for Law Enforcement, Interpol cooperation between countries specifically for cybersecurity.
