Abstract

The establishment of a special institution that handles money laundering in Indonesia, called the Financial Transaction Reports and Analysis Center (PPATK), as a central institution in the anti-money laundering system in Indonesia is regulated in Article 18 of the Republic of Indonesia Law No. 8 of 2010 concerning Prevention and Eradicating Money Laundering. The Financial Transaction Reports and Analysis Center (PPATK) is also an independent institution that has the duty and authority to prevent and eradicate money laundering, and to assist law enforcement relating to money laundering that is directly responsible to the President. The formulation of the problem in this research is: how is the financial service provider (Bank) in an effort to help the Financial Transaction Reports and Analysis Center (PPATK) prevent the occurrence of money laundering crimes and what obstacles and how the efforts of financial service providers in an effort to assist the Reporting and Analysis Center Financial Transactions (PPATK) prevent money laundering. The research method used in this study is normative legal research, namely by describing existing problems which are subsequently discussed and studied based on legal theories and then linked to the applicable laws and regulations in legal practice. The conclusions in this study are as follows: Financial service providers (Banks) in an effort to assist the Financial Transaction Reports and Analysis Center (PPATK) to prevent the occurrence of money laundering crimes has the main task of helping law enforcement agencies in preventing and overcoming money laundering crimes by providing intelligence information resulting from the analysis of reports submitted to the PPATK. Barriers to financial service providers in efforts to help the Financial Transaction Reports and Analysis Center (PPATK) prevent money laundering, among others: the presence of loopholes in financial service industry regulations, barriers from other laws and regulations, obstacles in international cooperation both by executive and judiciary and inadequate resources to prevent and find out about money laundering activities, for example the absence of a financial intelligent unit.Keywords: Banking, PPATK and Money Laundering

Abstract

Menurut Undang-undang Nomor 26 Tahun 2007 tentang Penataaan Ruang, bahwa Tata Ruang Wilayah adalah wujud dari struktur dan pola ruang, di mana struktur ruang adalah susunan pusat-pusat pemukiman dan system jaringan prasarana dan sarana yang berfungsi sebagai pendukung kegiatan sosial ekonomi masyarakat secara hierarki memiliki hubungan fungsional, sedangkan pola ruang secara nasional adalah distribusi peruntukan ruang dalam suatu wilayah yang meliputi peruntukan ruang yang berfungsi sebagai kawasan lindung dan peruntukan ruang yang berfungsi sebagai kawasan budidaya. Berdasarkan latar belakang masalah sebagaimana dikemukakan di atas, maka dapat dirumuskan beberapa masalah antara lain : Bagaimana Implementasi Kebijakan Penataan Ruang di Indonesia serta Bagaimana Kepastian Hukum Penataan Ruang Setelah Berlakunya Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang. Jenis penelitian yang dipergunakan dalam penelitian ini adalah jenis penelitian hukum normatif, yaitu melakukan analisis kebijakan penataan ruang oleh Pemerintah setelah berlakunya undang-undang Nomor 26 Tahun 2007 tentang Penataan Ruang. Hasil pembahasan dalam penelitian ini Implementasi Kebijakan Penataan Ruang di Indonesia Kebijakan penataan ruang oleh pemerintah setelah berlakunya Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang oleh Pemerintah dan pemerintah daerah dengan melibatkan peran masyarakat. Peran masyarakat merupakan hal yang sangat penting dalam penataan ruang karena pada akhirnya hasil penataan ruang adalah untuk kepentingan seluruh masyarakat serta untuk tercapainya tujuan penataan ruang, yaitu terwujudnya ruang wilayah nasional yang aman, nyaman, produktif, dan berkelanjutan dan Kepastian hukum penataan ruang wilayah setelah berlakunya Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang dimana kepastian hukum merupakan indicator profesionalisme dan syarat bagi kredibilitas pemerintahan, sebab bersifat vital dalam penyelenggaraan pemerintahan dan pembangunan, serta dalam pengembangan hubungan internasional. Tegaknya kepastian hukum juga mnesyaratkan kecermatan dalam penyusunan berbagai kebijakan pembangunan. Sebab berbagai kebijakan publik tersebut pada akhirnya harus dituangkan dalam system perundang-undangan untuk memiliki kekuatan hukum, dan harus mengandung kepastian hukum. Untuk menjamin adanya pemerintahan yang bersih (clean government) serta kepemerintahan yang baik maka pelaksanaan pembangunan hukum harus memenuhi kewajiban procedural (fairness), pertanggungjawaban publik (accountability) dan dapat dipenuhi kewajiban untuk peka terhadap aspirasi masyarakat (responsibility). According to Law Number 26 of 2007 concerning Spatial Planning, Regional Spatial Planning is a form of spatial structure and pattern, where spatial structure is the arrangement of residential centers and a network system of infrastructure and facilities that function to support community socio-economic activities in a hierarchical manner. has a functional relationship, while the national spatial pattern is the distribution of space allocations in a region which includes space allocations that function as protected areas and space allocations that function as cultivation areas. Based on the background of the problem as stated above, several problems can be formulated, including: How to Implement Spatial Planning Policy in Indonesia and What is the Legal Certainty of Spatial Planning After the Enactment of Law Number 26 of 2007 concerning Spatial Planning. The type of research used in this research is normative legal research, namely analyzing spatial planning policies by the Government after the enactment of Law Number 26 of 2007 concerning Spatial Planning. The results of the discussion in this research are Implementation of Spatial Planning Policy in Indonesia Spatial planning policy by the government after the enactment of Law Number 26 of 2007 concerning Spatial Planning by the Government and regional governments by involving the role of the community. The role of the community is very important in spatial planning because ultimately the results of spatial planning are for the benefit of the entire community and to achieve the goals of spatial planning, namely the creation of safe, comfortable, productive and sustainable national regional space and legal certainty for regional spatial planning after its enactment. Law Number 26 of 2007 concerning Spatial Planning where legal certainty is an indicator of professionalism and a requirement for government credibility, because it is vital in the administration of government and development, as well as in the development of international relations. Upholding legal certainty also requires accuracy in the preparation of various development policies. Because these various public policies must ultimately be stated in the legislative system to have legal force, and must contain legal certainty. To ensure clean government and good governance, the implementation of legal development must fulfill procedural obligations (fairness), public accountability (accountability) and fulfill the obligation to be sensitive to community aspirations (responsibility).

Abstract

The making of a deed of sale and purchase of land by a Notary / Land Deed Making Officer (PPAT) is not in accordance with the procedures for making a Land Deed Deed (PPAT). This is caused by the existence of situations and conditions in the sale and purchase which causes the discrepancy seems to be done so that the transaction or process of buying and selling land can take place. In accordance with the above bachground, the authors are interested in conducting further research with the little Notary-PPAT Action in Handling Land Rights Transfer Agreements that Have The Potential to Conflict : 1. The formulation of the problem is what are the factors that cause an agreement to transfer land rights to potential conflict. 2. What are the forms of action of a notary-PPAT in dealing with land rights transfer agreements that have the potential for conflict. This type of research is empirical legal research, namely research based on facts in the field and collected by processing certain data. The problem approach used is empirical-juridical, namely by examining the reality in the form of the case of the transfer of land rights agreement and then linking it with juridical facts which then tries to find solutions to the gaps. The conclusion of this study is the factors causing the occurrence of potentially conflicting agreements include: 1) There is a situation that requires the Land Deed Maker Official (PPAT) to make a deed of sale and purchase that is not in accordance with the procedures for making a PPAT deed, which is needed in order to save a sale and purchase transaction; 2) There is a very high mutual trust between fellow Land Deed Making Officials (PPAT) and between the parties and the PPAT; 3) The time and busyness factor of the parties; 4) Reasons for time efficiency for the parties due to the making of the deed of sale and purchase; 5) The factor of the value of the sale and purchase transaction; 6) Relationship and friendship factors; 7) Factors caused by a request from the parties. The forms of action of the Notary-PPAT in dealing with land rights transfer agreements that have the potential to conflict are a process in the context of motivational orientation and value orientation. On the principle of motivational orientation which refers to individual desires (Notary-PPAT) which acts to increase satisfaction and reduce losses, four basic considerations are found as follows: 1) Basic considerations of success; 2) Value considerations; 3) The basis for consideration of experience; 4) Rare opportunity considerations.
