Abstract

Penyelundupan manusia merupakan salah satu bentuk kejahatan transnasional terorganisasi yang menimbulkan permasalahan di berbagai belahan dunia, termasuk Indonesia yang dimanfaatkan sebagai negara transit oleh pelaku penyelundupan manusia. Untuk menanggulangi  kejahatan ini, Indonesia membentuk Undang-Undang No. 6 Tahun 2011 tentang Keimigrasian. Metode penelitian hukum yang digunakan dalam tulisan ini adalah metode penelitian hukum normatif, sebab terdapat kekosongan  norma terkait dengan pengaturan pertanggungjawaban pidana yang dilakukan oleh organisasi. Tujuan dari tulisan ini adalah untuk mengetahui faktor-faktor yang menjadikan Indonesia sebagai negara tujuan transit serta mengetahui pertanggungjawaban pidana pelaku penyelundupan manusia menurut hukum positif Indonesia.  Sulitnya pengawasan terhadap  wilayah kepulauan Indonesia yang sangat luas, letak Indonesia yang sangat strategis, lemahnya instrumen hukum nasional yang ada serta adanya oknum pejabat yang berperan dalam kegiatan ini menempatkan Indonesia sebagai negara favorit untuk transit.  Di samping itu, pertanggungjawaban pidana terhadap pelaku yang relatif ringan sebagaimana diatur dalam Undang-Undang Keimigrasian juga mengakibatkan kejahatan ini berkembang menjadi bisnis yang menguntungkan di Indonesia.

Abstract

The legal profession plays a crucial role in upholding justice and judicial authority. Advocates, as independent law enforcers, are bound by ethical standards governing their conduct in court. This study examines the enforcement of advocates' codes of ethics in Indonesia in contempt of court cases, focusing on the adequacy of the legal framework, the effectiveness of ethical sanctions, and implementation challenges through a normative legal approach supported by empirical data. The findings indicate that although Indonesia possesses a comprehensive normative basis through Law Number 18 of 2003 on Advocates, the Advocates' Code of Ethics, and provisions of the Criminal Code, the enforcement of ethical norms remains suboptimal in practice. Key obstacles include weak internal supervision mechanisms, fragmentation of advocate organizations, lack of transparency in ethical proceedings, conflicts of interest within disciplinary bodies, and the absence of clear guidelines distinguishing legitimate legal criticism from contempt of court. The case of advocate Firdaus Oiwobo illustrates the inconsistencies and delays in ethical enforcement, which ultimately undermine public trust in the legal profession. This study concludes that reforms are urgently needed, including the establishment of an independent and integrated ethical oversight body, the formulation of clear technical guidelines on contempt of court, and the strengthening of continuous legal ethics education. Such measures are essential to preserve the dignity of the legal profession, ensure legal certainty, and reinforce judicial authority in line with the principles of the rule of law.

Abstract

Tourism is an essential resource for regions that serve as tourist destinations. Indonesia, rich in culture and tourism, boasts a wide range of tourist sites spread across its provinces. One of Indonesia's premier tourist destinations is Bali, an island known for its unique natural and cultural wealth that attracts visitors from around the world. However, tourism development often conflicts with environmental preservation, such as the lack of attention to subak (traditional irrigation systems) in urban areas. Subak, with its cultural foundations, has the potential to be developed into tourist attractions (DTW). Therefore, the concept of ecotourism is seen as a suitable approach for developing tourism attractions in urban subak areas.This research focuses on the role of ecotourism as a model for developing tourism attractions within urban subak systems and the implications of this model based on tourism law principles in Denpasar. The research employs normative legal methods, using both statutory and conceptual approaches. The expected findings aim to serve as a foundation for formulating policies and strategies to develop ecotourism in Denpasar's urban subak areas. These policies and strategies should be grounded in tourism law principles while addressing aspects that need improvement for effective ecotourism implementation in urban subak areas.
