Abstract

Purwokerto has several cafes that use live music to attract customers. In live music, the performers present other people's songs in public with commercial purposes or to seek profit from the song. On the other hand, there are regulations governing the use of other people's creative works. The purpose of this study is to determine the procedure for playing songs at live music performances in cafes in Purwokerto and how the legal protection for playing songs in live music in cafes in Purwokerto is from the perspective of Copyrights Act and hifz al-mal. This study uses an empirical legal approach to analyze the cafe's compliance with economic rights in copyright. The type of research is field research. The results of the study indicate that copyright infringement is more relevant and serious in the context of large concerts that have a significant financial impact, where the use of songs without permission can substantially harm the copyright owner. In contrast, live music performed in cafes with minimal income and driven by humanitarian intentions to entertain or support the community is not considered a significant copyright infringement from a humanitarian perspective and the principle of hifz al-mal. This is due to its small financial impact and underlying good intentions, however, efforts are still needed to respect copyright in the long term in accordance with the principles of justice and protection of property in Copyrights act and hifz al-mal.

Abstract

Background: Falls among the elderly represent a significant public health issue, often leading to severe physical injuries, decreased quality of life, and increased healthcare costs. Purpose: This study aims to investigate the relationship between family support and fall risk among elderly individuals in Gresik. Methods: Utilizing a cross-sectional design, 150 elderly participants were surveyed using structured questionnaires assessing demographic characteristics, family support levels, and fall risk factors. Logistic regression analysis was employed to determine the influence of family support and other variables on fall risk. Results: The findings reveal that family support is significantly associated with fall risk, with high levels of family support reducing the likelihood of falls by 75% (OR = 0.25, 95% CI: 0.12-0.51, p < 0.001). Age was also identified as a significant predictor, with each additional year increasing fall risk by 15% (OR = 1.15, 95% CI: 1.02-1.30, p = 0.020). Gender and living arrangements were not statistically significant predictors. Demographic analysis showed that the majority of participants were aged 60-69 years, predominantly female, and living with family members, emphasizing the potential role of family dynamics in elderly care. Conclusion: This study underscores the importance of family support as a protective factor against falls in elderly populations. Interventions focusing on enhancing family involvement, such as caregiver training and home modifications, are recommended to mitigate fall risk. Future research should explore longitudinal designs and qualitative methods to further elucidate the mechanisms of family support in fall prevention.

Abstract

In carrying out married life, husband and wife have their respective roles and functions in maintaining family harmony and harmony. If someone's role does not go well, it can cause disruption or problems within the family. Efforts to reconcile the two parties to a dispute in the realm of judicial law are called mediation. The research aims to reveal the perspective of the mediator's duties according to the views of mediation officers at the Malang City Religious Court office. The application of research using qualitative methods is research that is able to produce analytical procedures without static analysis procedures or by using other quantification methods. The mediation mechanism at the Malang City Religious Court is in accordance with PERMA Regulation Number 1 of 2008, namely: Regarding the mediation process, after the parties choose a mediator to mediate their case, the parties provide a resume of their case to the mediator. If they fail to choose a mediator, then the case files are handed over to the mediator who has been chosen by the Chair of the Assembly. The influence of the mediator in making the case a success can affect the Judicial Body and also the public's trust in the Judicial Institution. The mediator's success in resolving cases can ease the burden on the Chairman of the Panel in handling burdensome divorce cases. The mediator's efforts in completing mediation can be said to be composed of the role, function, duties and authority of the mediator. It can be said that all the mediator's efforts, whether through his authority, the mediator cannot force a complete reconciliation or not to divorce. However, on the contrary, through the function, role, authority and skills of the mediator, peace can be created between the parties.   Keywords : Mediator, Mediation, Divorce, Peace
